The Graduate Certificate in Family Dispute Resolution is a postgraduate program offered by the Faculty of Law. In this program, students will develop and enhance their skills in conflict resolution and mediation with the subjects offered as part of the Graduate Certificate running in conjunction with the Dispute Resolution Centre, recognised as a leader in mediation excellence. Graduates of this program will demonstrate the knowledge, skills and understanding of the ethical principles as required by the National Mediator Accreditation System and will also have completed subjects which satisfy the six core competencies prescribed under the Family Law (Family Dispute Resolution Practitioners) Regulations 2008. On completion, this qualification may lead to national mediation accreditation as well as family dispute resolution practitioner registration.

About the program

The Graduate Certificate in Family Dispute Resolution is a postgraduate program offered by the Faculty of Law, which, on completion, may also lead to national mediation accreditation as well as family dispute resolution practitioner registration. The subjects offered as part of the Graduate Certificate run in conjunction with the Dispute Resolution Centre which is recognised as a leader in mediation excellence. Professional outcomes

Nationally Accredited Mediator

The first two subjects in the Graduate Certificate in Family Dispute Resolution meet the threshold training, education and assessment requirements for National Mediator Accreditation as set out in the Approval Standards in the National Mediator Accreditation System. National accreditation may be obtained by:

  1. Completing LAWS17/77-801: Mediation and Dispute Resolution Practice 1
  2. Completing LAWS17/77-802: Mediation and Dispute Resolution Practice 2
  3. Applying to a Registered Mediator Accreditation Body for registration

Family Dispute Resolution Practitioner Accreditation

The Federal Attorney-General's Department manages accreditation for Family Dispute Resolution Practitioners (DFRP). The subjects offered by Bond University meet the training and competency requirements equivalent to the six compulsory units of the Graduate Diploma of Family Dispute Resolution (CHC81115). On completion of the Graduate Certificate in Family Dispute Resolution, students may make an application to the Federal Attorney-General's Department for FDRP registration.

Please note, completion of the Graduate Certificate in Family Dispute Resolution will only make the student eligible to be accredited by the Federal Attorney-General's Department as a FDRP provided that if, at the time the student commenced the program, they satisfied at least one of the following requirements:

  • They held an undergraduate degree or higher qualification in Psychology, Social Work, Law, Conflict Management, Dispute Resolution, Family Law Mediation or equivalent; or
  • They held the Mediation skill set from the Community Services Training Package (CHC); or
  • They held accreditation under the National Mediator Accreditation System (NMAS); or
  • They were able to provide documented evidence of previous experience in a dispute resolution environment in a job role involving self-directed application of knowledge with substantial depth in some areas, exercise of independent judgment and decision-making, and a range of technical and other skills.

Students with concerns about their eligibility to be accredited as an FDRP should contact the Attorney-General's Practitioner Accreditation Unit directly.

Structure and subjects

The Graduate Certificate in Family Dispute Resolution comprises four (4) subjects (40 CP) and is completed part-time.

  • LAWS17/77-801: Mediation and Dispute Resolution Practice 1
  • LAWS17/77-802: Mediation and Dispute Resolution Practice 2
  • LAWS17/77-803: Family Dispute Resolution 1
  • LAWS17/77-804: Family Dispute Resolution 2

Mediation and Dispute Resolution Practice 1, Mediation and Dispute Resolution Practice 2 and Family Dispute Resolution 1 are delivered intensively with a requirement to attend on-campus workshops ranging in length from two to five days, depending on the subject. There is also a requirement to complete some online modules in advance of workshop sessions. Family Dispute Resolution 2 is based on a clinical requirement to complete 50 hours of supervised FDR practice and includes a clinical training intensive along with at least 20 hours of supervised family dispute resolution practice in an approved clinic.

- Description -

The pathway features three mandatory core modules on mechanisms of international dispute resolution between private parties, mechanisms under international and EU law as well as current developments in international dispute resolution, providing students with the essential basics in international dispute resolution.

Beyond these modules students have a wide range of options of specialized fields of international dispute resolution, ranging from modules on international commercial arbitration and international investment arbitration exclusively taught by some of the world’s leading barristers, to judicial protection in the EU, human rights law and litigation, an advanced seminar on selected topics in international arbitration, international mooting, climate change, arbitration and intellectual property, international investment law as well as policy, negotiation, transnational litigation, world trade law and oral advocacy – the latter module again co-taught by a world-renowned barrister.

Students without any background in international or EU law can acquire the relevant basic knowledge in this field in the first two weeks of the pathway, in two not-for-credit optional “foundational seminars”.

This LLM prepares students for a career in the challenging and exciting field of international dispute resolution. It provides them with a solid foundation in all relevant areasincluding both private and public international means of dispute resolution and allows them to specialize in the fields of their choice. The school combines both King’s award-winning academics and some of the world’s leading practitioners.

- Course format and assessment -

In the first and second semester you study your selection of taught modules (half and full). These are in most cases assessed in the third semester (May/June) by written examination, or in some cases by the submission of an assessed essay. The M.S. in Conflict Analysis & Resolution is designed to train reflective professionals in the practice, design, and evaluation of a variety of conflict resolution applications. The M.S. program focuses on pragmatic approaches to solving problems inherent in human social relations. Students are exposed to a wide array of techniques and strategies to help people achieve nonviolent, non-litigious solutions for conflicts that arise in many personal, professional, organizational, and social environments. The M.S. program consists of a 12-course (36 credits) sequence that includes conflict resolution theory, practice skills, field placement, research design, and program evaluation.

Transferring Credits

Graduates of our Master's program in Conflict Analysis and Resolution who decide to continue their studies and are accepted into our Ph.D. program in Conflict Analysis and Resolution, can transfer up to 15 credit hours to the Ph.D. program, thereby reducing the total number of credits for the doctoral program.

Program Formats

The M.S. program is offered in both residential and distance learning formats. These flexible formats allow mid-career working adults and those unable to attend the on-campus program, to study conflict resolution in a creative, rigorous, and structured fashion.

Students may enroll full or part time, taking six to nine credit hours per trimester. Students who attend full-time can expect to complete the program in 15 months. Part-time students will complete the program in 2 years. Summer attendance is mandatory.

Students taking online classes are required to attend 2 Residential Institutes (RI) per academic year. Each RI is 5 days. Currently the RIs are held in February and October. Please visit the Residential Institute for current information.

Master's students are provided NSU computer accounts including email and Blackboard, but must obtain their own Internet service providers, use their own computer systems and have a usable web camera. Online students use the web to access course materials, announcements, email, distance library services, subscription library databases, and other information, and for interaction with faculty and fellow students. Online, interactive learning methods are based on the use of Blackboard as a course management system. Online activities facilitate frequent student-to-faculty and student-to-student interaction. They are supported by threaded discussion boards, white boards, chat rooms, email, and multimedia presentations. In addition, Blackboard enables students to submit assignments online in multimedia formats and to receive their professors' reviews of assignments online in the same formats.

Curriculum

Masters students must complete a minimum of 36-credits; successfully pass a field practicum and a Comprehensive Examination or an optional thesis to be eligible for the degree. Students must also maintain a 3.0 GPA through completion of the degree. Some courses have specific prerequisite requirements that students must meet; these should be checked to ensure compliance. If a student chooses to they may opt to do the master's thesis.

Practicum

Practicum is a student centered learning experience that is supervised by professionals at a variety of local, regional, national, and international organizations, as well as monitored by the practicum coordinator and guided by faculty teaching the practicum sequence. Practicum I and II are offered both residentially and online, during the fall, winter and summer terms. Doctoral students do have the option of doing Teaching and Training which is offered in the fall, followed by a Teaching and Training practicum in the winter term. Students may follow either of these tracks.

Practicum provides opportunities that you must be active in creating. It provides the chance to explore employment settings and obtain a realistic feel for your level of expertise in conflict analysis and resolution. Practicum also offers you a preview of locations where conflict resolution is currently being used or where it can be introduced. Who is it for?

The course appeals to existing legal practitioners as well as those who wish to work in the field of civil and criminal litigation, arbitration, international litigation and dispute resolution, legal services and tribunals. As it is domestic and internationally focused, it should be of interest to students from the UK, Europe and around the world.

Objectives

The Specialist LLM in Dispute Resolution is a unique course which provides students with a strong understanding of dispute resolution practice and theory in both civil and criminal matters. It concentrates on issues relating to dispute resolution in criminal or civil justice, including conventional litigation as well as alternative dispute resolution practices such as arbitration and mediation. This course gives you an opportunity to explore the area of criminal and civil justice from a domestic, international and European law context.

Placements

Each year a small number of internships become available and you will be provided with information about such opportunities and how to apply during the year of your study.

Teaching and learning

This course is taught by leading academics as well as visiting practitioners including barristers and solicitors who work in private practice and in legal departments of major companies. All modules are structured as 10 weekly two-hour seminars which comprise both lectures as well as interactive tutorials. All modules are supported by our online learning platform - Moodle.

Assessment

Assessment is by way of coursework which comprises 100% of the final mark in each module. Each module carries the same weight in terms of the overall qualification. You will be allocated a dedicated supervisor for your dissertation who will help you develop a specific topic and provide support in terms of resources, content and structure.

Modules

As with all LLM specialisms at City, University of London, you may take either 5 modules and a shorter dissertation (10,000 words) or 4 modules and a longer dissertation (20,000 words). All modules are of the same duration and are taught per term (September – December or January – April) rather than the whole academic year. If you take 4 modules you will take 2 per term in each term and if you take 5 modules you will have 3 in one term and 2 in the other. Dissertations are written during the summer term when there are no classes.

In order to obtain this specialism, you must choose at least three modules from within this specialism and write your dissertation on a subject within the specialism.

Course Description:
This innovative cross-border programme allows M.Phil. students to take a broader joint course Master in Conflict Resolution and Reconciliation, or a specialist option for either a Master in Conflict Resolution or a Master in Reconciliation Studies. The Conflict Resolution specialism develops skills in conflict analysis and conflict intervention for both established practitioners and those seeking to develop new expertise in conflict management, conflict resolution and conflict transformation. The Reconciliation specialism offers an inter-disciplinary approach to the challenges of social reconciliation in the aftermath of political conflict, drawing on social research, politics, theology and ethics. Particular attention is given to ethnic conflicts, and the role of religion in such conflicts and in peacebuilding and reconciliation. Case studies typically include: Northern Ireland; South Africa; Zimbabwe; Rwanda; El Salvador; Guatemala; Israel/Palestine; and Sri Lanka. The programme equips graduates for work with local and international organisations, and provides transferable skills for a wide variety of careers, including mediation, diplomacy, policy, advocacy, journalism, teaching and Ph.D. research.

Students are required to take a 10 ECTS core module in Research Skills, a further 50 ECTS of taught modules, and a 30 ECTS research dissertation. This one-year course interests those who wish to study non-adversarial dispute resolution processes. It is of particular interest to those, in both the public and private sectors, who wish to study civil mediation and other non-adversarial dispute and conflict resolution processes which are increasingly a part of legislative and management structures in the EU and internationally. It aims at achieving standards of best practice for those who recognise the value of alternative dispute resolution processes in resolving commercial, community, workplace and other pre-litigation disputes and in minimising damage caused by conflict. Through an alliance with Mediation Forum-Ireland those who complete the CDRS course will have the opportunity to have their names included in the relevant specialist panel of Accredited Mediators. You will be taught by the School of International Arbitration, a centre for research and teaching in International Arbitration and Dispute Resolution at Queen Mary.

Mediation is developing at great speed in many countries. For example, it is part of the civil justice system of England and Wales through the Civil Procedure Rules and the provisions in the rules which encourage the use of mediation.

This diploma is aimed not only at lawyers, but also at other professionals who may be involved in mediation - be it as a disputant, representative or perhaps as a mediator. The course will introduce you to the process of mediation and its role in the resolution of disputes.

The core module, Alternative dispute resolution, interprets the subject as a truly interdisciplinary field comprising of law, social science, economics, psychology and others. This is a newly emerged and vibrant area of scholarship, hence it is impossible to give yes or no answers to most of the questions. Accordingly, the module will employ critical thinking and an open discussion approach. The School of International Arbitration (SIA) at Queen Mary aims to actively participate in the academic discussion on arbitration. It also aims to teach and train a future generation of lawyers that want to be involved in international arbitration. Frequently, lawyers that practice international arbitration, whether as counsel or as arbitrators, have a limited knowledge of the complex theoretical problems of this specialist subject. QLLM006 - Alternative Dispute Resolution- Students who successfully complete this module will be exempt from the Introduction to Alternative Dispute Resolution with CIArb and can therefore apply to become an Associate of CIArb.

LLM students who successfully complete module QLLM043 OR QLLM052 and the International Arbitration Award Writing Exam and who are practicing lawyers may be exempt from Module 1 also meaning that they can apply to become a Fellow of CIArb (Peer Interview may be required).

Mediation is developing at great speed in many countries. For example, it is part of the civil justice system of England and Wales through the Civil Procedure Rules and the provisions in the rules which encourage the use of mediation. Additional government initiatives in England and Wales have been introduced such as automatic referral to mediators for small claims court matters.

In Europe, the EU Directive on Cross-Border Mediation has led to the implementation of mediation legislation throughout the EU. Beyond Europe, other developments continue: for example, Japan has introduced mediation in its financial services sector; Hong Kong is promoting mediation through new legislation protecting confidentiality of the process; the International Bar Association has drafted investor-state mediation rules; Nigeria continues to develop its multi-door courthouses through which mediation is a primary process.

The Postgraduate Distance Learning Diploma in International Dispute Resolution - Mediation has a strong focus on mediation and conciliation. The course will introduce you to the process of mediation and its role in the resolution of disputes. The diploma not only provides an understanding of the theoretical, practical and ethical problems relating to international mediation, but can also provide a stepping stone for professionals to become involved in international alternative dispute resolution (ADR).

The diploma is aimed not only at lawyers, but also at other professionals who may be involved in mediation - be it as a disputant, representative or perhaps as a mediator: a legal qualification will not be a prerequisite for admission, although you will be expected to appreciate that the course will involve an understanding of law and legal implications. References and materials will be legally orientated, but this will enable the non-lawyer to be better equipped to deal with the issues raised in international business mediation.

A pilot scheme for the automatic referral to mediation in the UK County Court Money Claims Centre for claims of less than £5,000.
Automatic referral to mediators for small claims court matters (claims up to £5,000).
A Court of Appeal scheme whereby appeals of personal injury and contract claims of up to £200,000 will be automatically recommended for mediation.
The Department for Business, Innovations and Skills has instituted a pilot scheme for two regional mediation networks for small and medium sized enterprises.

Programme structure

You can study the Postgraduate Distance Learning Diploma in International Dispute Resolution - Mediation, part-time for a period of 18 months, starting in January each year.

The year is divided into two seven-month terms, with a selection of optional modules and dissertation being offered during the second term.
◦Taught modules (22.5 or 45 credits). Each module requires around seven and a half hours of work a week over one term. Each module assessment will vary and consist of assessed tasks, a module essay and final assessment exercise (take-home exam).
◦Dissertation (15,000-words) (45 credits) – on a topic of your own choice

Course articulation

Students who complete the Graduate Certificate of Conflict Management and Resolution may be eligible for entry to the Master of Conflict Management and Resolution, and may be granted advanced standing for all subjects completed under the Graduate Certificate.

Entry requirements (Additional)

English band level 1 - the minimum English Language test scores you need are:
*Academic IELTS – 6.0 (no component lower than 5.5), OR
*TOEFL – 550 (plus minimum Test of Written English score of 4.0), OR
*TOEFL (internet based) – 79 (minimum writing score of 19), OR
*Pearson (PTE Academic) - 57

If you meet the academic requirements for a course, but not the minimum English requirements, you will be given the opportunity to take an English program to improve your skills in addition to an offer to study a degree at JCU. The JCU degree offer will be conditional upon the student gaining a certain grade in their English program. This combination of courses is called a packaged offer.
JCU’s English language provider is Union Institute of Languages (UIL). UIL have teaching centres on both the Townsville and Cairns campuses.

Minimum English Language Proficiency Requirements

Applicants of non-English speaking backgrounds must meet the English language proficiency requirements of Band 1 – Schedule II of the JCU Admissions Policy.
