This module focuses on introducing students to the various areas of law and issues of professional practice used and applied in the construction and property industries.

- Construction and planning
A module to provide a broad and critical perspective on planning and construction, as well as an understanding of the context within which planning and construction decisions are made and implemented.

- Valuations
This module is intended to allow the theoretical knowledge gained in a series of lectures and workshops to be applied in practice. The module will consider the fundamental principles of valuation, valuation formula and discounted cash flows. It will examine the methods used in the valuation of office, retail, industrial and residential properties. The module will also introduce the process of development and redevelopment of property.

- Applied valuations and the management of property interests
This module gives a practical insight into managing property. The roles and responsibilities of both landlords and tenants are considered in property management. Financial calculations that inform property management decisions are also considered.

- Economics for property professionals
This module provides an introduction into a set of theoretical and practical principles that enable property professionals to develop, manage and grow successful businesses.

- Property development process
This module provides a broad and critical perspective on property development and an understanding of the context within which property development decisions are made and implemented.

- Project finance
This module provides the necessary skills and knowledge for project funding, project evaluation and management in the property industry.

- Planning law and practice

- Building control
The module focuses upon the control and enforcement of the Building Regulations and associated legislation, along with supporting technical documents and alternative solutions, to meet specific regulative requirements as they apply to various building schemes.

- Building information modelling and collaborative working
A module to provide a general understanding of the role that BIM can play throughout the design, construction and operation of building assets. It looks to identify and develop the necessary managerial, technical and interpersonal skills required to deliver better value through a collaborative BIM approach.

- Health and safety management in construction
This module focuses on the management of safety on site – a process that can be applied to a wide range of work settings and project types.

- History of architecture and construction
This module examines the inter-relationship between building design and production as it occurred throughout historical time. Particular attention will be paid to those periods in history when major transformations occurred in architectural style and the building process. Other historical themes will also be pursued.

- International real estate and construction
This module introduces students to the international context of real estate markets, construction industry and project development. It specifically focuses on the activity of international real estate investors and large construction companies. The module also provides students a comparative perspective on real estate markets and construction process.

- Legal resolution of property and construction disputes
This module focuses on the range of dispute resolution techniques used by construction and property professionals to resolve and manage disputes in the construction and property industries.

- Market report and case study analysis
Students on our Real Estate course can choose to study International Real Estate and Construction as an optional module. For this complex module students need to go on a study visit to an international city which has an emerging real estate and construction market.

Past students have gone abroad to take in either Dubai in the United Arab Emirates or Shanghai in the People's Republic of China. The field trip includes visits to real estate companies and construction firms, site visits and meetings with various professionals. From these briefings, students need to produce a country report that includes a detailed strategy including how they could break through in the real estate or construction market in these overseas destinations.

In today’s unpredictable financial markets, strategic financial decisions and policies frequently need to be considered in relation to various legal requirements and constraints.

Business people increasingly need to have an understanding of the financial and accounting principles which underpin and inform legal regulation of financial institutions, financial instruments and financial markets.

Consequently, finance graduates who also have a strong legal knowledge, will be very attractive to a range of financial institutions and other organisations, both in the UK and overseas.

This joint masters programme between the Department of Accounting & Finance and the Law School addresses this skills gap in the global market by introducing students to both the legal aspects of regulation of international finance as well as to principles of accounting and finance.

You’ll study

The programme comprises both core and optional classes in finance and law.

It aims to provide students with a number of key learning outcomes:

1. To understand the core elements of financial theory and corporate financial theory.*
2. To understand key elements in financial law and regulation including the private law in respect of the structuring of individual transactions and the public law relevant to regulation of financial markets and institutions from the perspective of UK, EU and international law.*

* Students will have the option of developing skills in various specialist areas in finance or business and commercial law.

Facilities

Strathclyde Business School has undergone a £23.2 million transformation to locate departments in a single business quarter and provide state-of-the-art teaching facilities for our staff and students. The major refurbishment includes two new 100-seat lecture theatres, tutorial rooms for up to 40 people and smaller break-out rooms.

Key Features of Intellectual Property and Commercial Practice

The LLM in Intellectual Property and Commercial Practice requires commitment to study throughout one calendar year. Students are given the opportunity to develop a number of important skills which are not only essential to those wishing to become lawyers but are valuable, transferable skills in themselves in other employment contexts. The Department of Shipping and Trade Law offers its students dedicated resources, including IT facilities and teaching rooms. Students of the Intellectual Property and Commercial Practice programme are fully supported by the College's dedicated Law Librarian and the Law Library holds an extensive selection of legal materials and on-line services such as Lexis and Westlaw. Students are encouraged to make full use of the facilities offered by the Shipping and Trade Law Department and, in particular, to take advantage of training sessions run by the Department, such as the legal research methods and Employability sessions, as well as of the Visiting Lectures’ series.

Modules

The LLM in Intellectual Property and Commercial Practice degree is modular, with students required to accumulate 180 credits to graduate. In appropriate circumstances, a student of LLM in Intellectual Property and Commercial Practice may graduate with a merit or distinction. Each programme is divided into two parts: Part I consists of 4 taught modules each weighted at 30 credits. Students undertaking an LLM in Intellectual Property and Commercial Practice are required to take four modules from the following list. It is compulsory for students on the LLM Intellectual Property and Commercial Practice to study Law of Intellectual Assets Management and Transactions. The LLM Research Projects will customarily be researched and written up over the summer period and are designed to enable LLM in Intellectual Property and Commercial Practice students to develop their research skills.

Careers & Employability

The International Careers Adviser at Swansea runs weekly workshops for international students for example, on how to improve career prospects and improve interview techniques. The Postgraduate Department also employs two dedicated LLM employability officers who run a series of talks to develop the skills of LLM students and inform their career plans.

The Department also enjoys close links with law firms. For example, Associate Professor Andrew Beale OBE is a consultant with Capital Law and offers legal advice on IP matters. The Swansea LLM is well known internationally. Many of our graduates secure employment shortly after completing their degrees. o The theoretical teaching of this Master is very thorough, covering everything needed to know in the associated professions. As a consequence, the students are very adaptable within the work market.

Practical information
The Master’s degree counts for 120 ECTS (European Credit Transfer System) in total and lasts two years. The training lasts 1316 hours (646 hours in M1 and 670 hours in M2). The semesters are divided as follows:

o M2 courses take place from September until mid-April and count for a total of 44 ECTS
o A five-month internship (in France) from mid- April until mid- September for 16 ECTS. Usual indemnities are around 1000 € per month.

MPhil courses offered by the Department of Land Economy share common aims. These are:

i) to enable students of a high calibre to pursue their education at an advanced applied level drawing on the primary disciplines of economics, planning and environmental policy, with additional specialisms in finance and law;

ii) to provide students with opportunities both to build on and develop material which they may have studied at undergraduate level as well as to broaden their knowledge base;

iii) to equip students with the necessary skills to pursue careers at a high level in a range of areas, including business and finance, civil service, public service, property professions, environmental agencies and organisations, national/international agencies and further study;

The postgraduate programmes offered within the Law School are usually taught in seminar format. Students on the Diploma and LLM programmes study three modules in each of the autumn and spring terms. The modules normally are assessed by a 4-5,000-word essay. Students undertaking an LLM degree must write a dissertation of 15-20,000 words.

Module Details

You will study a total of five units which incorporate a range of topics covering economic theories and principles and how they can explain the existence, nature and operation of retail, wholesale and international banking. We will also guide you in applying sophisticated forecasting techniques to help you understand and anticipate business trends, and with our guidance you will learn how to design and deliver research to the highest standards. The course then concludes with your dissertation where you’ll engage in economic research on a topic of your choice.

Here are the units you will study:

Contracts, Markets and Regulation:

You will learn about contemporary economic theories which assist with identifying issues, problems and solutions, and how these are applied to decision-making. Topics include the objectives of the firm, creating and sustaining competitive advantage, consumer behaviour and strategic choices, advertising and innovation, principal-agent theory, property rights and the boundaries of the firm, regulation, social welfare and public policy.

Financial Econometrics:

You will gain a strong practical understanding of the econometric tools you will be using throughout your study of finance. The teaching philosophy is to take an applied approach, in order to provide you with a strong, intuitive understanding of the most important statistical techniques and how to apply them successfully to a wide variety of practical situations in finance. To do this, you will use the main statistical packages, such as Eviews and SPSS.

Finance and Financial Markets:

In the first part of this unit you will study corporate finance and financial decision-making. You will learn about the ideas and techniques used by corporations to make decisions on investment, financing, dividend policy and capital structure. In the second part you will study finance from the financial markets’ perspective, covering stock and bond pricing models, portfolio investment and risk management using derivatives, such as futures, forwards, options and swaps.

International Banking:

In this unit you will study commercial and investment banking at national, international and global levels. Topics covered include money and the banking system, banking structures and regulations, risk management in banking, scale and scope economies and the measurement of competition in banking, determinants of bank crashes and failures, global banking and regulation, global financial markets and instruments and derivatives-related financial crises.

Research Methods and Dissertation:

You will need to complete a scheme of independent research. We offer comprehensive training via lectures and workshops throughout the year to develop skills commensurate with standards of good research practice.

This programme is designed to equip students with a comprehensive and specialist education in a range of areas within International Intellectual Property Law. The course will enable students to master the basic principles of the four main ‘pillars’ of IP Law, namely, Copyright, Patents, Trade marks and Industrial Designs. The four main components of IP Law will be examined from three distinct perspectives: domestic (UK), EU and International (global treaties/conventions) and will encompass analysis of legislation, case law (common law and civil law) and specific legal concepts. Where possible, comparative analysis will be carried out as between for example, specific EU IP Law developments and those of third country States e.g. India, Pakistan and China. In addition, certain third countries with well-developed, mature IP systems (e.g. the U.S., Canada and Australia) will be examined for a comparative assessment. The distinct themes of how the Internet has brought about new thinking in the IP world and, possible overlapping forms of IP protection (e.g. copyright and patent protection of computer software) will be examined.

Through carefully designed course work and varied teaching approaches, students from both a common law and civil law background will acquire the intellectual open-ness, technical expertise and critical thinking abilities that are necessary for effectiveness in a globalising world. The programme will equip students to respond effectively to the wide range of intellectual and professional challenges facing contemporary intellectual property lawyers. The LLM in International Intellectual Property Law will equip them to deal with both case work and policy making.

Employment opportunities for graduates of the programme will include work with international law firms, patent and trade mark attorneys, local Intellectual Property Offices (e.g. the UK Intellectual Property Office, Chinese Patent and Trade Mark Office and the Office of the Controller General of Patents, Designs and Trade Marks in India),international organisations such as the World Intellectual Property Organisation (WIPO), World Trade Organisation (WTO) and the United Nations and specialist bodies within the EU e.g. the Office for the Harmonisation of the Internal Market (OHIM) and the European Patent Office (EPO). Directorate-General Internal Market and Services of the European Commission deals with IP matters and is also a potential employer. Other potential employers include international courts and tribunals, think tanks and research centres (e.g. the specialist Max Planck Institute for Intellectual Property and Competition Law (Munich), non-governmental organisations and government (eg. Ministries of Justice; Business, Innovation and Skills and; Foreign Affairs). Teaching will mostly be seminar-based which will promote group and individual interaction, which also ensures that every individual student is encouraged to contribute to discussions. Seminar-based teaching enables lecturers and students to discuss issues and investigate topics in greater depth, and develops critical thinking and solution-based learning skills in students; whilst also allowing the course teachers to monitor closely each individual’s progress. Emphasis will be placed on the use of virtual learning through the mechanism of the Blackboard computer-assisted learning system and databases such as Westlaw and LexisNexis. Throughout all modules, comparative elements with other legal systems will be emphasised.

Initially in the first stage, you will examine the key challenges faced by global businesses to fully appreciate the complexity and dynamics of leadership and management practice. During the second stage of your course, you will explore international financial management, including international investment strategies, Capital Asset Pricing and the financial aspects of national and international merger and acquisitions. You’ll learn how to navigate the risks of foreign exchange rates and the intricacies of dividend policy theory and practice for international firms.

You’ll be taught international business strategy while also developing your research skills in preparation for your major project. In addition to the Major project, you will also study both personal and institutional portfolio management, covering key areas such as shares, bonds, property chattels and commodities, and fund management principles and issues.

The final core Major Project module is tailored to your career aspirations. The module provides three project options:
-A work-based study route enabling you to relate the project to a current employer;
-A consultancy project option, where you find a client who has an international business problem that you feel you can solve;
-A traditional dissertation involving an in-depth exploration of both the theory and practice of international business using primary research.

Course Structure

The course runs for 12 months (full-time, September start) and is split into three stages, each lasting at least 10 weeks. Assessment is of a practical nature, including assignments, reports, presentations and examinations.

Each module consists a mixture of lectures, seminars, workshops, online interactive activities and assessments. Typically each module is taught on a weekly basis during term time, consisting of three hours per module per week split into one, two or three-hour sessions. A total of 9 contact hours per week is typical over a 10 week period for Stage 1 and Stage 2. Stage 3 will consist of three hours of contact time per week, supplemented with project supervision meetings as and when required for the Major Project.

Each 20-credit module is designed to require 200 hours of study, of which 30 hours or more will be via direct contact with module tutors. The remaining time will consist of independent learning, which will be structured with guidance from the module tutor to incorporate activities such as online learning, reading and group or team based work.

Emphasis will be placed on the group as a resource for learning. There will be group discussion of practical management situations and problems, making use of case studies, problem situations and scenarios and, where relevant, the participants' own experiences.

Assessment on the programme is designed to be an integral part of your learning process, enhancing and demonstrating your knowledge and practice. Formative feedback will be provided to you through a combination of self-reflection, peer group and tutor feedback. Summative assessments will provide a measure of the extent to you have achieved the learning outcomes of the modules.

Assessment within the modules will take various forms, including coursework assignments, reports, controlled assessment, examinations and the dissertation or project. You may be required to defend the dissertation or project through a viva, drawing on the skills developed in the programme.

This personal research project of 12,000 to 14,000 words is usually linked to an aspect of real estate that has a specific professional application or is of personal interest to you.

The student on this course obtaining the highest mark for an investment-related dissertation may be eligible (depending on grade obtained) for a prize from the IPF worth £500.
