Overview (General information) This one-year part-time flagship Diploma programme is a comprehensive learning and practice experience. The course is based on the theoretical foundations of mediation and includes analysis of conflict theory, negotiation theory and approaches to conflict intervention and marries this with intensive practice skills development throughout the year. It explores multiple fields for the application and practice of mediation and conflict intervention in society today including Families, Workplace Mediation, Commercial Mediation, Restorative Justice, Conflict Resolution in Education, Peacemaking, Community Mediation and Multiparty Policy Disputes. The programme prepares students for professional certification in mediation with the Mediator’s Institute of Ireland.

The course is structured around theoretical presentations and skills development through exercises and role-play and the introduction to specialised areas of mediation practice as mentioned above.

Accreditation

The Diploma is aimed at those who wish to develop mediation skills for application in their area of work or for developing a career in mediation. Graduates will receive a Diploma in Mediation from the Edward Kennedy Institute, Maynooth University and those who successfully take the Mediation Roleplay Competency Assessment can apply to the Mediator’s Institute of Ireland for Certified Status as a Mediator.



Gain knowledge of the theory and practice of mediation, conflict paradigms and conflict intervention theory principles and practice, so that they have a strong theoretical base to their practice.
Develop mediation and conflict intervention skills through the application of theory to practice in role-play so that they are skillful mediation practioners.

Are prepared to take a Mediation Competency Assessment.
Have an introduction to Community & Workplace Mediation, Mediation & Labour Relations, Multiparty Mediation for Public Policy Disputes, School and Family Mediation, Peacemaking and Restorative Practice.

The course comprises five modules each of five days duration, held on Mondays from 09.30 to 17.00 over the academic year (end September to beginning May). Students learn through lectures, skills training and project work. Students are obliged to attend 80% of the course.

Assessment

Students must complete two assignments per module and take part in a competency assessment of mediation skills at end of year.


The Diploma is aimed at those who wish to develop mediation skills for application in their area of work or for developing a career in mediation. Successful graduates of the programme will receive a Diploma in Mediation from the Edward Kennedy Institute, Maynooth University and will have passed a competency assessment whereupon they may register with the Mediator’s Institute of Ireland as a certified mediator.

Graduates will generally find work in this field through self employment. Agencies which provide a conflict management consultancy and/or mediation service employ mediators. Many graduates use the knowledge and skills gained on the course for application in their current employment.

Additional government initiatives in England and Wales have been introduced such as automatic referral to mediators for small claims court matters.

In Europe, the EU Directive on Cross-Border Mediation has led to the implementation of mediation legislation throughout the EU. Beyond Europe, other developments continue: for example, Japan has introduced mediation in its financial services sector; Hong Kong is promoting mediation through new legislation protecting confidentiality of the process; the International Bar Association has drafted investor-state mediation rules; Nigeria continues to develop its multi-door courthouses through which mediation is a primary process.

The Postgraduate Distance Learning Diploma in International Dispute Resolution - Mediation has a strong focus on mediation and conciliation. The course will introduce you to the process of mediation and its role in the resolution of disputes. The diploma not only provides an understanding of the theoretical, practical and ethical problems relating to international mediation, but can also provide a stepping stone for professionals to become involved in international alternative dispute resolution (ADR).

The diploma is aimed not only at lawyers, but also at other professionals who may be involved in mediation - be it as a disputant, representative or perhaps as a mediator: a legal qualification will not be a prerequisite for admission, although you will be expected to appreciate that the course will involve an understanding of law and legal implications. References and materials will be legally orientated, but this will enable the non-lawyer to be better equipped to deal with the issues raised in international business mediation.

Programme structure

You can study the Postgraduate Distance Learning Diploma in International Dispute Resolution - Mediation, part-time for a period of 18 months, starting in January each year.

The year is divided into two seven-month terms, with a selection of optional modules and dissertation being offered during the second term.
◦Taught modules (22.5 or 45 credits). Each module requires around seven and a half hours of work a week over one term. Each module assessment will vary and consist of assessed tasks, a module essay and final assessment exercise (take-home exam).

The MA in Mediation and Conflict Intervention at Edward Kennedy Institute, Maynooth University provides a learning experience for those who wish to deepen and integrate their mediation and conflict intervention knowledge and skills. The programme delivers specialist professional training in the areas of Organisational and Workplace Mediation, Family Mediation, Commercial Mediation, Restorative Practice and Peace Process Studies, providing the professional knowledge and skills necessary for practice in these areas. Students complete nine modules of 10 credits each over a two-year duration.

This highly experiential programme provides ongoing opportunities to learn reflectively through exercises and in practice through feedback and coaching while formal presentations provide background theory in the specialist areas. Students gain a strong theoretical foundation coupled with skills and practice development leading to a solid grounding in the best practice of constructive conflict intervention processes.

The MA in Mediation and Conflict Intervention is designed for those people who are intently interested in furthering their skills base and knowledge in the field of mediation and conflict intervention. Participants will usually have been working directly or indirectly with people in conflict as a professional or as someone required to handle conflict situations in their work or personal lives. Participating in this programme will further develop theoretical knowledge and applied skills in conflict analysis, mediation and other specialist chosen areas of study. The programme is designed to be an intense learning experience where small class sizes encourage strong skills development and engagement in a continuous and collaborative learning environment.

The course is accredited by the Mediators Institute of Ireland (MII) and students who are not already certified mediators with the MII must undergo and pass the first module (MC615) via assignment and competency assessment. This will enable students to register with the MII as a certified Mediator with eligibility to practice. Completion of the Masters programme will provide further requirements for Practitioner Accreditation. This senior status is achieved when the student has successfully completed the course and also has completed cases to MII standard (see Mediators Institute of Ireland website: http://www.themii.ie).

Course Structure

Two Year Part Time Programme

Each year has a different schedule with some modules repeated each year.

In the academic year of 2017-2018 the first semester delivers the following modules. Research (MC603), Mediation Knowledge and Practice (MC615), Family Mediation (MC604), Mediation Theory into Practice (MC628), Values and Relationship in Mediation and Conflict Intervention (MC601) and Restorative Practices (MC608). The second semester modules are Commercial Mediation (MC607), Workplace Mediation (MC605), Peace Studies 1 - Resolving Protracted Conflict (MC629) and Peace Studies 2 -Post Conflict Challenges in Implementing Peace Agreements (MC630).

Year two modules include Mediation Knowledge and Practice (MC615), Family Mediation (MC604), Mediation Theory and Conflict Analysis (MC601), Organisational and Workplace Mediation (MC605), Conflict Resolution in Education (MC611) and Restorative Practice in Schools (MC616).

Schedule

The course is structured in modules of 6 days each. Each 6 day module in turn is (usually) broken down into two 3 day blocks (Thursday, Friday, and Saturday). The Restorative Practices Module (MC608) is structured in three blocks of two days, Thursdays and Fridays. The majority of modules are delivered on campus, however some course days are delivered off campus ( MC608, MC629 and MC630), in the North of Ireland or Glencree Centre for Peace and Reconciliation, Enniskerry. Students take the internship module Mediation Theory into Practice (MC628) off campus.

Students must complete one compulsory module MC601 or MC606 each year, whichever is being delivered in the year. Students without appropriate accreditation as a mediator must complete and pass MC615, the first module on offer each year. Students complete nine modules in total over two academic years.
While every attempt will be made to keep to dates advertised it is important to note that all dates are provisional and will be confirmed upon commencement of the programme.

Career Options

Graduates are provided with the knowledge base for practice in the specialist areas of mediation and many other conflict intervention systems taught on the course. Graduates who have completed module MC615 and passed the competency assessment may apply to register with the Mediators Institute of Ireland (MII) and advertise their practice as a certified mediator. On completion of supervised cases, graduates may apply for assessment to the advanced level of Practitioner Member with the MII. Graduates may incorporate their learning into their current employment or the development of their future career. Others may choose self-employment offering a variety of services including mediation, conflict analysis, conflict management, facilitation and other conflict interventions to prospective clients. Some agencies, providing a mediation service, employ mediators, which provides another option.

The skills of conflict resolution are crucial in contemporary life. Professionals in business, public bodies and the law are increasingly expected to act in a collaborative way and to resolve disputes without the delay and expense of litigation. Mediation is fast becoming a core skill.

In response to popular demand, from 2014/15 you can graduate with either an LLM or MSc. Students whose dissertations deal with significant legal or justice questions receive recognition via an LLM. You’ll study

The course can be studied on a full-time or part-time basis via a combination of evening and weekend classes, distance learning and personal study.

On a full-time basis, the LLM/MSc requires you to complete three modules in each of two semesters followed by a dissertation in a chosen research topic. Part-time students would normally undertake three modules per year.

As well as a rigorous theoretical grounding in the principles of mediation and conflict resolution, the course provides opportunities for you to acquire the skills of a mediator through simulations and case studies.

Mediation clinic

A unique aspect of studying for this qualification is that, as a student on the course, you can become a member of the Mediation Clinic. This is a student-led mediation service for the Greater Glasgow area.

The clinic exists to help people resolve disputes without going to court or tribunal. Since February 2014, it's been providing an in-court mediation service for small claims party litigants at Glasgow Sheriff Court. Each mediation is conducted by a lead mediator and student mediator.

Facilities

Our library has a wide range of law reports, legislation, serials and monographs. It also has duplicate sets of key law report series, houses extensive collections in government publications and other related areas.

Course awards

The core module, Alternative dispute resolution, interprets the subject as a truly interdisciplinary field comprising of law, social science, economics, psychology and others. This is a newly emerged and vibrant area of scholarship, hence it is impossible to give yes or no answers to most of the questions. Accordingly, the module will employ critical thinking and an open discussion approach. It is expected that you will be willing to share results of your research and be involved in active discussion of all issues.

All taught modules are taught as part of the LLM degree. On this Diploma there are core modules which you must take in order to qualify.

There are two distinct Diploma routes, Arbitration or Mediation, to choose from, each with their own specialised focus.

Continuous assessment will provide regular feedback and enhance the student-tutor relationship. Students will also be able to address questions and concerns directly to the course convenor and the course director. Participants are entitled to use specialist electronic databases, such as Westlaw, Lexis Nexis and Kluwer Arbitration.

Why is the course relevant?

Mediation is developing at great speed in many countries. For example, it is part of the civil justice system of England and Wales through the Civil Procedure Rules and the provisions in the rules which encourage the use of mediation. Additional government initiatives in England and Wales have been introduced such as:

A pilot scheme for the automatic referral to mediation in the UK County Court Money Claims Centre for claims of less than £5,000.
Automatic referral to mediators for small claims court matters (claims up to £5,000).
A Court of Appeal scheme whereby appeals of personal injury and contract claims of up to £100,000 will be automatically recommended for mediation.
The Department for Business, Innovations and Skills has instituted a pilot scheme for two regional mediation networks for small and medium sized enterprises.
In Europe, the EU Directive on Cross-Border Mediation (2008/52/EC) has led to the implementation of mediation legislation throughout the EU. Beyond Europe, other developments continue: for example, Japan has introduced mediation in its financial services sector; Hong Kong is promoting mediation through new legislation protecting confidentiality of the process; the International Bar Association has drafted investor-state mediation rules; Nigeria continues to develop its multi-door courthouses through which mediation is a primary process.

Workplace research indicates that managers and supervisors spend as much as forty percent of the workday resolving nonproductive conflict issues. Conflict that is poorly managed results in burdening costs for both the individual and the organization. Expanding worldwide development, the global economy, and population growth and associated social issues drive the intermingling of cultures and practices that increase the incidence of workplace conflict and destructive disagreement. Interest in and demand for conflict management has consequently risen.

The Graduate Certificate in Conflict Management, Negotiation, and Mediation provides students with the tools to manage, resolve, negotiate, and mediate conflict and to develop intrapersonal and interpersonal skills for living and earning. Conflict management training actively engages the student in self-exploration regarding issues of perception, bigotry, bias, values, beliefs, differences, and culture. The student will learn how to verbally and physically converse without allowing differences to interfere with collaboration. Business, government, and community agencies value these skills to increase productivity and to maximize a positive workplace climate. Overview

This programme empowers actors and practitioners from development, security and other peace and security related institutional backgrounds involved in international peace-building with the knowledge, skills and competencies that will enable them to provide leadership to reduce and ultimately eliminate violent conflict.

This master’s programme will provide a challenging learning experience for those who wish to develop and integrate mediation and negotiation knowledge and skills with their awareness of wider conflict and development issues while providing students with a critical insight of the entire spectrum of international conflict intervention.

The main theme of the programme will be an integrated and comprehensive approach to the the nexus of peacebuilding, security and development. With increased awareness of the importance of these interlinkages has come increased demands on national and international institutions to respond in a holistic way. In the field, security actors are required to have a better understanding and greater skills in engaging with local communities, institutions and organizations at the local level, while development practitioners recognise a skills deficit with respect to conflict resolution and mediation and are increasingly expected to understand and engage with representatives of multifaceted agencies and communities, particularly when anticipating or responding to the consequences of complex crises.

Students will develop

Conceptual and strategic analytical capacity, including ability to analyse and articulate the violent conflict dimension of complex issues that require an integrated and comprehensive response.
Demonstrated problem-solving skills and judgment in applying technical expertise to resolve a wide range of complex and unusual issues/problems and in developing innovative and creative solutions.
Ability to negotiate and to influence others to reach agreement.
Knowledge of institutional mandates, policies and guidelines pertaining to interventions in violent conflict.
The programme describes the process of negotiating and implementing peace agreements and security actors and international interventions, drawing in senior personnel experienced in peacekeeping/ peace making and security operations. It also explores the notion of partner and aid donors, the contribution of international organisations and cooperation with key strategic partners and the use of broad development instruments in support of conflict prevention and peace building.

Completion of the module, Mediation Knowledge and Practice provides the basis for the opportunity to take a Mediation Competency Assessment and on successfully passing this assessment, the student is in a position to apply for Certified Status with the Mediators Institute of Ireland.

Course Structure

The programme will be a fulltime offering every second year from August 2017 onwards. The programme will be delivered in the following manner;

In following a fulltime programme, students must complete- 30 credits per semester and complete a dissertation within the 14 month period of the programme. A flexible approach to delivery will be taken, through blended learning. Classroom based modules will be provided on campus in Maynooth University or in Kimmage Development Studies Centre, as part of existing Maynooth University MA programmes.

For development modules, on-campus delivery of each 5 credit module involves 24 hours of class-contact. adopts a flexible approach to delivery of classroom based modules with some courses offered through 2 hour taught classes over 12 weeks (usually in the evenings) while others are offered through more concentrated blocks of time depending on timetable requirements and arrangements (typically 4.5 day blocks, delivered in a single week or over two weeks). Distance learning modules are structured to allow students to study at their own pace over a semester, with modules running in two cycles annually – October through January and February through May / June.

For the Kennedy Institute, classroom based modules which are normally 10 credits typically involve week long blocks (4.5 days). Each 1 ECTS module will typically involve at least 20 hours of work, including attending lectures, reading, writing coursework, preparing for exams and sitting exams.

For the dissertation module, master classes on research design /methods will be provided by lecturers, and lecturers will provide supervision sessions, which will amount to 36 hours. Students must also undertake approximately 500 hours of independent study when completing the dissertation.

Who is it for?

The Civil Litigation and Dispute Resolution LLM degree should interest and benefit a broad range of students. If you are already professionally qualified having taken the Bar Professional Training Course (BPTC) or Legal Practice Course (LPC) it will develop your understanding of practice and enhance your career. If you have legal qualifications in another jurisdiction it will provide understanding of legal process in England. Objectives

Teaching and learning

This course is taught by leading academics as well as visiting practitioners including barristers and solicitors who work in private practice and in legal departments of major companies.

All modules are structured as 10 weekly two-hour seminars which comprise both lectures as well as interactive tutorials. All modules are supported by our online learning platform Moodle.

Assessment

Assessment is by way of coursework which comprises 100% of the final mark in each module. Each module carries the same weight in terms of the overall qualification.

You will be allocated a dedicated supervisor for your dissertation who will help them develop a specific topic and provide support in terms of resources, content and structure.

As with all LLM specialisms at City, University of London, you may take either 5 modules and a shorter dissertation (10,000 words) or 4 modules and a longer dissertation (20,000 words). All modules are of the same duration and are taught per term (September – December or January – April) rather than the whole academic year. If you take 4 modules you will take 2 per term in each term and if you take 5 modules you will have 3 in one term and 2 in the other. The focus of governments and humanitarian NGOs has progressively shifted towards conflict prevention and building sustainable peace. Yet to prevent conflict or to build a secure and inclusive state and society after conflict involves a complex set of skills straddling conflict analysis, conflict mediation and negotiation, peace processes, state stabilisation, post-conflict reconstruction, peace building and early warning.

This inter-disciplinary, custom-designed MSc offers the opportunity to develop operational and vocational skills for conflict prevention and peacebuilding within the context of the latest theories on conflict and conflict prevention. Students will acquire the analytical skills to map conflict dynamics, design conflict sensitive projects and develop early warning mechanisms, enabling them to better predict, and so avoid, the outbreak of violent conflicts. They will also gain the skills necessary to assess and evaluate the impact and outcomes of interventions.

The MSc is designed for practitioners looking to enhance their existing skills, as well as graduates with a career in conflict prevention, conflict mediation, or post-conflict reconstruction in mind. It is particularly aimed at those seeking to work or already working in the (I)NGO sector, governmental departments or inter-governmental organisations.

While rooted in peace and conflict studies, the MSc draws on strategic and security studies as well as development studies, enabling much needed cross-fertilisation between these traditionally divergent perspectives. It draws on real-life case studies as well as interactive role plays, and exposes students to both cutting-edge academic developments and the latest practitioner experience, with a particular focus on bottom-up approaches.

Courses are taught by a mixture of academics and practitioners, and cover both critical and problem-solving approaches. Conflict dynamics are analysed drawing on multiple disciplines, including security studies, peace studies, anthropology, law, archaeology, history and political theory. Modules include both traditional, term-long modules and short, usually more skills-oriented continuing professional development courses as well as fieldtrips (e.g. fieldtrips have been organised to Nepal, Kenya, Lebanon, Sri Lanka and Kosovo).

The MSc will provide students with advanced knowledge of the complex and specialised areas of peacebuilding, among it conflict analysis, conflict prevention, conflict resolution and conflict transformation, community driven reconstruction, peace processes within the context of contemporary conflicts and in the context of broader international (humanitarian) interventions. Integrated into the MSc structure are opportunities to develop operational and vocational skills for example in negotiations, conflict mediation, conflict sensitive programme design and programme management, or urban peacebuilding. Students are provided with theoretical and empirical knowledge and with practical skills that are helpful for current and future employment opportunities. The courses are thus attractive to both graduates and mid-career practitioners. Whilst the academic and applied focus of the MSc comes through a peace and conflict studies analytic lens, course material will also draw from traditional strategic/security and development studies, enabling cross fertilisation between different perspectives. It allows the exploration of unique and new paradigms and practices in the fields of conflict, peace, security, defence, diplomacy, development and humanitarian intervention.

Learning and Teaching

At the beginning of the academic year, as well as the general induction programme offered by the School and the university, Durham Global Security Institute (DGSi) students are invited to a programme specific induction. This induction provides an overview of the programme an opportunity to meet members of the team and an opportunity to discuss optional module choices.

The 180 credits one-year MSc degree programme is divided into five core and three optional modules of 15 credits each. Students also have to submit a dissertation (60 credits) of not more than15,000 words. Practitioners have the option of writing an in-depth policy document as their dissertation.

Most of the modules are delivered during the first two terms and students spend the remaining time to write the dissertation. Assessment methods include: an examination, essays, presentations, reflective journal, reports, article reviews and policy briefs.

Although all modules have 18/19 contact hours, the core modules are spread over 9/10 weeks and 132 hours of self-directed learning. The modules are mainly delivered through weekly 2-hour sessions which take the form of a one hour lecture and a one hour tutorial. The form in which seminars are conducted can differ from one module to another. Typically modules would have elements of lectures, discussions, and presentations from students—the extent of each of these components would differ from one module to another. The optional modules of the programme are either delivered over two full days, through a mixture of lectures, Q&A sessions, seminar discussions, and role plays or over a single term in 2-hour seminar sessions. There is also the opportunity to participate in a study visit which provides an opportunity to investigate issues ‘in the field’ concerned with conflict prevention, conflict resolution, state and peace-building. Of particular interest is the theory-practice linkage

Students can also meet their module coordinators or programme coordinator during their weekly contact hours or by making an appointment. When students are working on their dissertations during the latter half of the year, they are required to attend two 4-hour workshops. In addition, they have the opportunity to meet their assigned supervisors for an average of 6 meetings. The School hosts events throughout the year which all postgraduate students are invited to attend. Students are also fully integrated into the Durham Global Security Institute which also hosts guest lectures and seminars throughout the year. These events provide students with the opportunity to engage with, and debate, the most important issues in current political and international studies, and in conflict, peace and security studies.

Alternative dispute resolution (ADR) enables disagreeing parties to resolve disputes through a wide spectrum of avenues such as arbitration, mediation and conciliation, without having to resort to litigation. ADR is a fast-growing area which will offer you a challenging and satisfying career through an array of emerging professional roles. It will appeal to graduates, lawyers, business managers and professionals who are interested in exploring this fascinating and diverse subject.

This part-time Postgraduate Certificate (PgCert) ADR comprises two taught modules and has been designed for those who are unable to commit to the full LLM ADR programme. It gives you an introduction to the theory and practice of a variety of dispute resulotion mechanisms as well as a grounding in the relevant law. At a later date, you have the option to take two further taught units and a dissertation or professional practitioner project to top up to the full LLM qualification.

Undertaking this new programme will enable you to understand the theory and practice of negotiation and conciliation from mediation of small scale personnel disputes to large scale international commercial arbitrations. It is a step on the route to becoming an accredited mediator or chartered arbitrator which offers a wealth of opportunities for career progression in this rapidly developing area of professional practice.

We are a recognised course provider for the Chartered Institute of Arbitrators (CIArb) and law graduates will have the option of qualifying as a Member of the CIArb if appropriate options are selected. This will allow you to use the letters MCIArb after your name and offers an accelerated route to qualification as a chartered arbitrator.

You will study two mandatory units from list the list below:

Legal Approach to Business (core if you do not already hold a Law degree or equivalent qualification/experience)
Commercial and Consumer Law (for students with a qualifying Law degree)
Theory and Practice of ADR

Programme Assessment

The course offers a balanced structure of lectures and seminars together with practical exercises such as simulations and case studies. Teaching is in small groups providing an informal, friendly and supportive atmosphere.
