The LLM in Intellectual Property Law programme allows students to study introductory and advanced intellectual property (IP) and technology law and to scrutinise the policies affecting intellectual property and technology law under the guidance of leading scholars in the field. Students will be able to study a wide range of topics from the protection of inventions, products, trade marks, creative works and designs to the global policy surrounding the law.

Overview

Intellectual Property Law has become an interdisciplinary field comprised of law, engineering, medical science, economics, and numerous other fields. The MSc in Management of Intellectual Property explores the foundations of this area of law with relation to patents, trade marks and the other core areas within this field.

This Masters of Science is primarily aimed at science and engineering graduates who wish to pursue a career as patent or trade mark attorneys, though it is also open to graduates from all academic backgrounds who wish to study Intellectual Property (IP) at postgraduate level.

There is continued need for expertise in intellectual property law and management in industry, commerce and the innovative and creative industries, and this MSc gives you the opportunity to study IP to a high level. The programme offers a professional stream (for science and technology graduates), and a business stream, available to graduates from all fields looking to expand their knowledge of the application and management of IP.

Professional stream
The professional stream is directed towards graduates (primarily sciences and other technical industries, but also from all other backgrounds) seeking qualification as patent and trade mark attorneys.

Business stream
Students on the business stream will gain profound knowledge of the law and its operation with a view to working in areas such as the press and media, the entertainment industry, the internet and software industries, or the luxury goods industries. Further sectors where knowledge in Intellectual Property and related areas is seen as a particular advantage include governments, international organisations, universities or non-governmental institutions.

This programme will:
◦Give you a choice of two streams to suit your background; a professional stream for science and engineering graduates, and a business stream for graduates of other disciplines.
◦Offer science and engineering graduates the opportunity to gain professional exemptions from Chartered Institute of Patent Attorneys (CIPA) and Institute of Trade Mark Attorneys (ITMA).

What is Intellectual Property (IP) law?

Intellectual Property Law has become an interdisciplinary field comprising law, engineering, medical science, economics, and numerous other fields. This programme teaches the foundations of this area of law with relation to patents, trademarks and the other core areas within this field.

Why study Intellectual Property law?

The MSc Management of Intellectual Property programme was developed as we recognised the increasingly important role of intellectual property in our modern economy. There is an emerging need in industry, in commerce and in those professions concerned with intellectual property law, for science and technology graduates who have studied intellectual property law to a high level. In industry, particularly in small and medium-sized firms involved in research and development, where there is no in-house lawyer or patent agent, there is often a need for an intermediary between the firms and the external lawyer or patent agent for example; or for an executive to handle the inward or outward licensing of technology, to negotiate research and development contracts (where ownership of intellectual property is usually central to the bargaining) or generally to have a basic knowledge of current developments in the field of business law (eg. contract law, product liability law) insofar as these may relate to the firm's present or future activities.

With the introduction of the new business stream we also offer a distinct avenue for graduates from all backgrounds to gain valuable knowledge of intellectual property.

Structure of the MSc in Management of Intellectual Property

Classes usually commence mid-September with examinations in May/June. Courses are taught during the day at Queen Mary University of London campuses and usually take place between 9.00am and 5.00pm.

There is an initial Basic English Law examination which takes place two weeks after the start of the programme. Students then select which stream they wish to undertake.

Compulsory modules:

◦Study project (45 credits)
◦Basic principles of English law, evidence and practice (non-credit bearing but all students must pass this module at the start of the programme)

All students require 180 credits in total.

Professional stream students have core modules plus one free choice half module of 22.5 credits. In addition to this, professional stream students also sit two additional papers to gain exemption from the foundation papers of CIPA and ITMA, both papers must be passed to gain the exemption for either institution.

Business stream students have a free choice of 135 credits (three full modules or six half modules, or a combination of the two.)

All students are required to study the core subject units: Patent law, Copyright and designs law, Law of trade marks and unfair competition, Competition law, and Basic principles of English law, evidence and practice in term one. Occasional additional second semester options may be available.

Students following this LLM in Intellectual Property and Commercial Practice will gain an in-depth legal knowledge of issues and the practical skills acquired will make them an invaluable asset to international commercial organisations.

Key Features of Intellectual Property and Commercial Practice

The LLM in Intellectual Property and Commercial Practice requires commitment to study throughout one calendar year. Students are given the opportunity to develop a number of important skills which are not only essential to those wishing to become lawyers but are valuable, transferable skills in themselves in other employment contexts. The Department of Shipping and Trade Law offers its students dedicated resources, including IT facilities and teaching rooms. Students of the Intellectual Property and Commercial Practice programme are fully supported by the College's dedicated Law Librarian and the Law Library holds an extensive selection of legal materials and on-line services such as Lexis and Westlaw. Students are encouraged to make full use of the facilities offered by the Shipping and Trade Law Department and, in particular, to take advantage of training sessions run by the Department, such as the legal research methods and Employability sessions, as well as of the Visiting Lectures’ series.

Modules

The LLM in Intellectual Property and Commercial Practice degree is modular, with students required to accumulate 180 credits to graduate. In appropriate circumstances, a student of LLM in Intellectual Property and Commercial Practice may graduate with a merit or distinction. Each programme is divided into two parts: Part I consists of 4 taught modules each weighted at 30 credits. Students undertaking an LLM in Intellectual Property and Commercial Practice are required to take four modules from the following list. It is compulsory for students on the LLM Intellectual Property and Commercial Practice to study Law of Intellectual Assets Management and Transactions. Students will also be required to take 3 modules from the rest of the modules listed below:

Following the successful completion of the taught modules, LLM in Intellectual Property and Commercial Practice students proceed to Part II, which is composed of two projects (LLM Research Projects). At least one of the LLM Research Projects must be written in the area of the Law of Intellectual Assets Management & Transactions. The LLM Research Projects will customarily be researched and written up over the summer period and are designed to enable LLM in Intellectual Property and Commercial Practice students to develop their research skills.

Throughout their studies, LLM in Intellectual Property and Commercial Practice students are provided with the opportunity to take part in a number of extra-curricular activities and enhance their practical understanding of shipping, insurance and commercial practice. Such activities include;

Careers & Employability

The International Careers Adviser at Swansea runs weekly workshops for international students for example, on how to improve career prospects and improve interview techniques. The Postgraduate Department also employs two dedicated LLM employability officers who run a series of talks to develop the skills of LLM students and inform their career plans.

The Department also enjoys close links with law firms. For example, Associate Professor Andrew Beale OBE is a consultant with Capital Law and offers legal advice on IP matters. The Swansea LLM is well known internationally. Many of our graduates secure employment shortly after completing their degrees. Several international firms keep a close relationship with the Department of Shipping and Trade Law and regularly send representatives for guest lectures and graduate recruitment purposes. Also every year the Shipping and Trade Law Department hosts the LLM Careers Fair which is attended by representatives from a wide range of local and international organisations. The core subjects of the programme are intended to equip students with both an advanced knowledge of substantive intellectual property law and of the place and role of intellectual property within a domestic, regional and international context, laying a foundation for a specialised dissertation.

The programme spans comparative study of the laws of patents, copyright, trademarks, designs, database protection, breach of confidence, passing off and related sui generis rights, as well as investigating a range of issues which underpin contemporary intellectual property law.

The programme allows students to explore intellectual property law not just in its legal but also social, ethical, cultural and commercial contexts.

About the Course

This is an intensive course which develops a sound practitioner’s foundation in UK and overseas intellectual property law and practice. Students will attain understanding of the law of patents, trademarks, copyright and industrial designs and its application in various professional sectors.

Focusing on intellectual property registration and prosecution, the course explores both contentious and non-contentious matters and develops the intellectual and practical skills necessary for those wishing to join the exciting and competitive professions of patent, trademark attorneys, intellectual property litigators and lawyers specialising in intellectual property.
This course provides a thorough grounding in intellectual property law, a rapidly-expanding area. Upon successful completion of the Intellectual Property PG Cert, students who wish to qualify as patent or/and trademark attorneys receive full exemption from all foundation qualifying examinations set by the Chartered Institute of Patent Attorneys and the Joint Examination Board and from three out of four elements of the Law Course recently set by Institute of Trademark Attorneys to supersede the previous Trade Mark Foundation papers.

The Course consists of two taught modules running concurrently through the teaching year:

It covers the following subjects:

- Fundamentals of the English legal system.
- Challenges faced by IP practitioners. Ethics and codes of practice.
- Patent law: Rationale, requirements for patentability, ownership and licensing, infringement, remedies, defences. Practice and management of patents: Obtaining a patent in the UK, EPC procedure, PCT procedure. Obtaining a patent in other jurisdictions.
- Copyright law. Rationale and subsistence, subject matter (literary, artistic, musical and dramatic works), ownership, licensing, moral rights, economic rights, infringement, permitted acts.
- Trade mark law. Registration, Absolute grounds for refusal of registration, infringement and relative grounds for refusal of registration, defences, invalidity, revocation, use. Practice and management of trade marks: Registering and maintaining a trade mark in the UK, International and transnational options for trade mark protection, registration and maintenance in other jurisdictions.
- The law of passing off and the legal protection for unregistered trade marks in the UK.
- Design rights: Registered and unregistered design, qualifying for protection, infringement, defences, invalidity and overlap with copyright.
- Practice and management of industrial design: Registering and maintaining a design in the UK and internationally.
- Elements of the law of breach of confidence: The legal protection of trade secrets and confidential information.
- Intellectual property licensing (negotiation, international perspectives – jurisdiction clauses, arbitration requirements) and elements of technology transfer.

This programme is designed to equip students with a comprehensive and specialist education in a range of areas within International Intellectual Property Law. The course will enable students to master the basic principles of the four main ‘pillars’ of IP Law, namely, Copyright, Patents, Trade marks and Industrial Designs. The four main components of IP Law will be examined from three distinct perspectives: domestic (UK), EU and International (global treaties/conventions) and will encompass analysis of legislation, case law (common law and civil law) and specific legal concepts. Where possible, comparative analysis will be carried out as between for example, specific EU IP Law developments and those of third country States e.g. India, Pakistan and China. In addition, certain third countries with well-developed, mature IP systems (e.g. the U.S., Canada and Australia) will be examined for a comparative assessment. The distinct themes of how the Internet has brought about new thinking in the IP world and, possible overlapping forms of IP protection (e.g. copyright and patent protection of computer software) will be examined.

Through carefully designed course work and varied teaching approaches, students from both a common law and civil law background will acquire the intellectual open-ness, technical expertise and critical thinking abilities that are necessary for effectiveness in a globalising world. The programme will equip students to respond effectively to the wide range of intellectual and professional challenges facing contemporary intellectual property lawyers. The LLM in International Intellectual Property Law will equip them to deal with both case work and policy making.

Employment Opportunities
Employment opportunities for graduates of the programme will include work with international law firms, patent and trade mark attorneys, local Intellectual Property Offices (e.g. the UK Intellectual Property Office, Chinese Patent and Trade Mark Office and the Office of the Controller General of Patents, Designs and Trade Marks in India),international organisations such as the World Intellectual Property Organisation (WIPO), World Trade Organisation (WTO) and the United Nations and specialist bodies within the EU e.g. the Office for the Harmonisation of the Internal Market (OHIM) and the European Patent Office (EPO). Directorate-General Internal Market and Services of the European Commission deals with IP matters and is also a potential employer. Other potential employers include international courts and tribunals, think tanks and research centres (e.g. the specialist Max Planck Institute for Intellectual Property and Competition Law (Munich), non-governmental organisations and government (eg. Ministries of Justice; Business, Innovation and Skills and; Foreign Affairs). Teaching will mostly be seminar-based which will promote group and individual interaction, which also ensures that every individual student is encouraged to contribute to discussions. Seminar-based teaching enables lecturers and students to discuss issues and investigate topics in greater depth, and develops critical thinking and solution-based learning skills in students; whilst also allowing the course teachers to monitor closely each individual’s progress. Emphasis will be placed on the use of virtual learning through the mechanism of the Blackboard computer-assisted learning system and databases such as Westlaw and LexisNexis. Throughout all modules, comparative elements with other legal systems will be emphasised.

Ideas and patterns of thought always have been, and continue to be, subject to historical change. The ways in which they change, and the reasons why they do so, make for fascinating study.

In this comprehensive programme, you’ll be introduced to the principal methodologies of intellectual history and become familiar with some key theoretical areas, such as Begriffsgeschichte and the Cambridge School.

You will also have the opportunity to explore particular themes in intellectual history, such as Epicureanism, mind-body dualism in early modern thought, the Scottish Enlightenment and the intellectual history of the American revolution, developing a detailed understanding of their origins, historical circumstances and implications.

By the end of the programme you’ll have the tools you need to appreciate the interdependence of text and context and the importance of ideas in past and present, as well as the ability to research effectively and present your work with confidence.

The postgraduate programmes offered within the Law School are usually taught in seminar format. Students on the Diploma and LLM programmes study three modules in each of the autumn and spring terms. The modules normally are assessed by a 4-5,000-word essay. Students undertaking an LLM degree must write a dissertation of 15-20,000 words.

Course detail

The MPhil in Political Thought and Intellectual History offers students a rounded and flexible Masters programme that provides them with an introduction to all three of the fields contained within its scope (History of Political Thought, Political Theory, Intellectual History), while allowing them to specialise in their own area of particular interest. It offers a thorough training in the key techniques of higher-level academic study and research.

The MPhil is inter-Faculty: History, Politics, and Classics are the participating departments. The teaching staff, and examiners, have diverse disciplinary backgrounds, as do students on the course.

Learning Outcomes

After completion of the MPhil in Political Thought and Intellectual History, students should have:

1. acquired an enhanced understanding of the history of political thought as well as an appreciation of the broader theoretical approaches and intellectual idioms that inform its study.
2. acquired the analytical capacity to pursue independent study of primary texts in the history of political thought and to evaluate the findings of secondary commentators
3. acquired the ability to situate their own research findings within the context of previous and current interpretative scholarly debates in the field of political thought and intellectual history

Format

The course comprises two kinds of work: group study and individually tailored supervised research training. Both persist simultaneously throughout the year, so that students are expected to attend the course classes, research seminar, and lectures while at the same time researching their essays. While there are no fixed course classes in Easter Term when students will be concentrating on their dissertation, they will be required to present their work at a Dissertation Seminar and encouraged to continue attending lectures and the research seminar. Postgraduate students in Cambridge are expected to work continuously throughout the year with the exception of a few days’ break at a time, so that the ‘vacation periods’ are in fact periods in which required work must be completed.

Students will receive the following feedback:

- oral supervision feedback
- writen termly CGSRS reports
- written essay feedback
- oral dissertation workshop feedback
- formal written feedback from two examiners after the submission and examination of their dissertation.

Assessment

A thesis of 15,000 - 20,000 words is submitted at the end of the course. An oral examination will only be required in cases where one of the marks is a marginal fail.

Two essays of not more than 6,000 words each, one submitted at the end of Michaelmas Term, the second at the end of Lent Term. These essays constitute Part I of the MPhil, and contribute to the final overall mark.

Continuing

In order to be considered for continuation to the PhD, and always subject to satisfactory supervision arrangements being in place, students are expected to obtain an overall mark of 70 for the MPhil and a mark of at least 70 for their dissertation.

The programme is mapped to the national Researcher Development Framework and covers a diverse range of topics, including subjectspecific research skills, research management, personal effectiveness, communication skills, networking and teamworking, and career management skills.

Our postgraduate courses provide detailed knowledge of intellectual and developmental disabilities. Graduates will have gained a very good understanding of the matters arising within this population and will be able to analyse and conduct relevant research.

Our postgraduate courses improve employability prospects for both those with established careers and new entrants to the field. Many of our students already work with people with intellectual and developmental disabilities in professional, management or supporting capacities. Our programmes support their continuing professional development and enhance their opportunities for career advancement. Other students, who are at the beginning of their careers, move on to a range of professional roles in health and social care including working as psychologists in learning disability or behavioural specialists in community learning disability teams; service management of development roles; clinical psychology training or a PhD.

2016 Postgraduate Tizard programmes will close to applicants at 23:59 hrs on Thursday 21 April 2016. Applications received after this time will be held for consideration for 2017 entry. The final tranche of interviews for 2016 will be held during the week of 23 May 2016. Applicants unable to make themselves available this week (in person or via skype or telephone) will be considered for 2017 entry.

This programme is an advanced professional development programme involving some or all of the following: distance learning; study workshops; service placement visits; and a clinical placement (which can be in your home area).

Coursework is taught through a mixture of web-based resources, directed reading, videos, lectures, seminars and practical sessions, supported by a number of workshops, where you work with skilled professionals and have the opportunity to share ideas and experiences with fellow students.

You work in two different placements during the course of the programme: a service placement based at the Tizard Centre and an individual clinical placement based in a community learning disability team or social care service. You complete a dissertation which must be based on empirical research in services.

About the Tizard Centre

The Tizard Centre is part of the School of Social Policy, Sociology and Social Research (SSPSSR) and has excellent links with health and social care organisations, and other relevant establishments.

The Centre is at the forefront of learning and research in autism, intellectual disability and community care, and in 2013 received a Queen’s Anniversary Prize in recognition of its outstanding work in these areas.

- to find out more about how to effectively support and work with people with learning disabilities

- to help carers, managers and professionals develop the values, knowledge and skills that enable better services

The Tizard Centre is recognised as leading the field in deinstitutionalisation and community living, challenging behaviour, quality of staff support, sexuality and autism, and has had a significant impact on national policies in these areas. This list is based on the current curriculum and may change year to year in response to new curriculum developments and innovation. Most programmes will require you to study a combination of compulsory and optional modules. You may also have the option to take modules from other programmes so that you may customise your programme and explore other subject areas that interest you.

Assessment

Each of the four taught modules is assessed by a one-hour, web-based, multiple-choice exam and an extended essay. In addition, the Research Methods module involves short assignments and a worked problem. Placements are assessed by two 2,000-word service reports and one 4,000-word case report, plus feedback by placement supervisors.
