The Graduate Certificate in Family Dispute Resolution is a postgraduate program offered by the Faculty of Law. In this program, students will develop and enhance their skills in conflict resolution and mediation with the subjects offered as part of the Graduate Certificate running in conjunction with the Dispute Resolution Centre, recognised as a leader in mediation excellence. Graduates of this program will demonstrate the knowledge, skills and understanding of the ethical principles as required by the National Mediator Accreditation System and will also have completed subjects which satisfy the six core competencies prescribed under the Family Law (Family Dispute Resolution Practitioners) Regulations 2008. On completion, this qualification may lead to national mediation accreditation as well as family dispute resolution practitioner registration.

About the program

The Graduate Certificate in Family Dispute Resolution is a postgraduate program offered by the Faculty of Law, which, on completion, may also lead to national mediation accreditation as well as family dispute resolution practitioner registration. Nationally Accredited Mediator

The first two subjects in the Graduate Certificate in Family Dispute Resolution meet the threshold training, education and assessment requirements for National Mediator Accreditation as set out in the Approval Standards in the National Mediator Accreditation System. National accreditation may be obtained by:

  1. Completing LAWS17/77-801: Mediation and Dispute Resolution Practice 1
  2. Completing LAWS17/77-802: Mediation and Dispute Resolution Practice 2
  3. Applying to a Registered Mediator Accreditation Body for registration

Family Dispute Resolution Practitioner Accreditation

The Federal Attorney-General's Department manages accreditation for Family Dispute Resolution Practitioners (DFRP). The subjects offered by Bond University meet the training and competency requirements equivalent to the six compulsory units of the Graduate Diploma of Family Dispute Resolution (CHC81115). On completion of the Graduate Certificate in Family Dispute Resolution, students may make an application to the Federal Attorney-General's Department for FDRP registration.

Please note, completion of the Graduate Certificate in Family Dispute Resolution will only make the student eligible to be accredited by the Federal Attorney-General's Department as a FDRP provided that if, at the time the student commenced the program, they satisfied at least one of the following requirements:

  • They held an undergraduate degree or higher qualification in Psychology, Social Work, Law, Conflict Management, Dispute Resolution, Family Law Mediation or equivalent; or
  • They held the Mediation skill set from the Community Services Training Package (CHC); or
  • They held accreditation under the National Mediator Accreditation System (NMAS); or
  • They were able to provide documented evidence of previous experience in a dispute resolution environment in a job role involving self-directed application of knowledge with substantial depth in some areas, exercise of independent judgment and decision-making, and a range of technical and other skills.

Students with concerns about their eligibility to be accredited as an FDRP should contact the Attorney-General's Practitioner Accreditation Unit directly.

Structure and subjects

The Graduate Certificate in Family Dispute Resolution comprises four (4) subjects (40 CP) and is completed part-time.

  • LAWS17/77-803: Family Dispute Resolution 1
  • LAWS17/77-804: Family Dispute Resolution 2

Mediation and Dispute Resolution Practice 1, Mediation and Dispute Resolution Practice 2 and Family Dispute Resolution 1 are delivered intensively with a requirement to attend on-campus workshops ranging in length from two to five days, depending on the subject. There is also a requirement to complete some online modules in advance of workshop sessions. Family Dispute Resolution 2 is based on a clinical requirement to complete 50 hours of supervised FDR practice and includes a clinical training intensive along with at least 20 hours of supervised family dispute resolution practice in an approved clinic.

The MA in Mediation and Conflict Intervention at Edward Kennedy Institute, Maynooth University provides a learning experience for those who wish to deepen and integrate their mediation and conflict intervention knowledge and skills. The programme delivers specialist professional training in the areas of Organisational and Workplace Mediation, Family Mediation, Commercial Mediation, Restorative Practice and Peace Process Studies, providing the professional knowledge and skills necessary for practice in these areas. Students complete nine modules of 10 credits each over a two-year duration.

This highly experiential programme provides ongoing opportunities to learn reflectively through exercises and in practice through feedback and coaching while formal presentations provide background theory in the specialist areas. Students gain a strong theoretical foundation coupled with skills and practice development leading to a solid grounding in the best practice of constructive conflict intervention processes.

The MA in Mediation and Conflict Intervention is designed for those people who are intently interested in furthering their skills base and knowledge in the field of mediation and conflict intervention. Participants will usually have been working directly or indirectly with people in conflict as a professional or as someone required to handle conflict situations in their work or personal lives. Participating in this programme will further develop theoretical knowledge and applied skills in conflict analysis, mediation and other specialist chosen areas of study. The programme is designed to be an intense learning experience where small class sizes encourage strong skills development and engagement in a continuous and collaborative learning environment.

The course is accredited by the Mediators Institute of Ireland (MII) and students who are not already certified mediators with the MII must undergo and pass the first module (MC615) via assignment and competency assessment. This will enable students to register with the MII as a certified Mediator with eligibility to practice. Completion of the Masters programme will provide further requirements for Practitioner Accreditation. This senior status is achieved when the student has successfully completed the course and also has completed cases to MII standard (see Mediators Institute of Ireland website: http://www.themii.ie).

Course Structure

Two Year Part Time Programme

Each year has a different schedule with some modules repeated each year.

In the academic year of 2017-2018 the first semester delivers the following modules. Research (MC603), Mediation Knowledge and Practice (MC615), Family Mediation (MC604), Mediation Theory into Practice (MC628), Values and Relationship in Mediation and Conflict Intervention (MC601) and Restorative Practices (MC608). The second semester modules are Commercial Mediation (MC607), Workplace Mediation (MC605), Peace Studies 1 - Resolving Protracted Conflict (MC629) and Peace Studies 2 -Post Conflict Challenges in Implementing Peace Agreements (MC630).

Year two modules include Mediation Knowledge and Practice (MC615), Family Mediation (MC604), Mediation Theory and Conflict Analysis (MC601), Organisational and Workplace Mediation (MC605), Conflict Resolution in Education (MC611) and Restorative Practice in Schools (MC616).

Schedule

The course is structured in modules of 6 days each. Each 6 day module in turn is (usually) broken down into two 3 day blocks (Thursday, Friday, and Saturday). The Restorative Practices Module (MC608) is structured in three blocks of two days, Thursdays and Fridays. The majority of modules are delivered on campus, however some course days are delivered off campus ( MC608, MC629 and MC630), in the North of Ireland or Glencree Centre for Peace and Reconciliation, Enniskerry. Students take the internship module Mediation Theory into Practice (MC628) off campus.

Students must complete one compulsory module MC601 or MC606 each year, whichever is being delivered in the year. Students without appropriate accreditation as a mediator must complete and pass MC615, the first module on offer each year. Students complete nine modules in total over two academic years.
While every attempt will be made to keep to dates advertised it is important to note that all dates are provisional and will be confirmed upon commencement of the programme.

Career Options

Graduates are provided with the knowledge base for practice in the specialist areas of mediation and many other conflict intervention systems taught on the course. Graduates who have completed module MC615 and passed the competency assessment may apply to register with the Mediators Institute of Ireland (MII) and advertise their practice as a certified mediator. On completion of supervised cases, graduates may apply for assessment to the advanced level of Practitioner Member with the MII. Graduates may incorporate their learning into their current employment or the development of their future career. Others may choose self-employment offering a variety of services including mediation, conflict analysis, conflict management, facilitation and other conflict interventions to prospective clients. Some agencies, providing a mediation service, employ mediators, which provides another option.

Whilst you may read the case law of cases that do go to court, a surprising amount of cases don't reach court. This is in part due to a combination of more regulation insisting the disputes are discussed and negotiated if possible before court action, and the fact that taking actions to court is a highly expensive process. This is often due to court fees, barrister fees and experts, all required to supply evidence prior and during court trials. There are many methods to improve situations before resorting to court action. You are taught a range of negotiation and dispute resolution methods and this programme can be invaluable to you in any profession within the law.

Being able to negotiate a solution in which all parties agree can be a very worthwhile process in which evidence and issues are openly discussed for all sides to hear and understand. Dispute resolution applies to many different areas of law which include family, employment, contracts, international, environment, intellectual property and many areas of law. Still the only course of its kind in the UK, the programme is rigorous and multi-disciplinary, exposing you to a wide range of approaches as well as being taught by experts from across the UK.

The skills of conflict resolution are crucial in contemporary life. Professionals in business, public bodies and the law are increasingly expected to act in a collaborative way and to resolve disputes without the delay and expense of litigation. Mediation is fast becoming a core skill.

In response to popular demand, from 2014/15 you can graduate with either an LLM or MSc. Students whose dissertations deal with significant legal or justice questions receive recognition via an LLM. Those who take a social science or empirical approach will graduate with an MSc. This division reflects the range of students taking the course, who include:

You’ll study

The course can be studied on a full-time or part-time basis via a combination of evening and weekend classes, distance learning and personal study.

On a full-time basis, the LLM/MSc requires you to complete three modules in each of two semesters followed by a dissertation in a chosen research topic. Part-time students would normally undertake three modules per year.

As well as a rigorous theoretical grounding in the principles of mediation and conflict resolution, the course provides opportunities for you to acquire the skills of a mediator through simulations and case studies.

Mediation clinic

A unique aspect of studying for this qualification is that, as a student on the course, you can become a member of the Mediation Clinic. This is a student-led mediation service for the Greater Glasgow area.

The clinic exists to help people resolve disputes without going to court or tribunal. Since February 2014, it's been providing an in-court mediation service for small claims party litigants at Glasgow Sheriff Court. Each mediation is conducted by a lead mediator and student mediator.

Facilities

Our library has a wide range of law reports, legislation, serials and monographs. It also has duplicate sets of key law report series, houses extensive collections in government publications and other related areas.

Course awards

Accreditation

CONSUMER SCIENCES

Students must complete 30 hours of coursework. A minimum of 24 semester hours of course credit, including HES 509, two courses in statistics, and 15 hours in courses in the area of specialization are required. Students must complete 6 credit hours of thesis research and write a thesis. A final oral examination is required upon completion of the thesis, and a manuscript of publishable quality based on the thesis research is expected of each Plan I degree candidate.

FAMILY FINANCIAL PLANNING AND COUNSELING

In the financial planning specialty within the 30-hour Master of Science degree program, students will study economic and social influences on the family and learn how to help individuals and families achieve their financial goals. Coursework includes 24 hours of financial planning coursework and 6 hours of electives in the area of specialization. By taking two courses each semester, students may complete this M.S. degree in less than two years. The program is offered both in Tuscaloosa and by distance.

CONSUMER CONFLICT MANAGEMENT, NEGOTIATION, AND MEDIATION

The certificate requires the successful completion of 15 hours of course work, in addition to the hours required for the masters in the student’s discipline. All 15 hours may count toward the master’s degree. Students must apply and gain admission to the UA Graduate School. Students must adhere to all UA Graduate School admission policies and deadlines. See Section 4.3 of the UA Graduate Catalog.

Students who wish to complete the Graduate Certificate in Conflict Management, Negotiation, and Mediation must meet admissions criteria for the Master’s degree in General Studies in Human Environmental Sciences with a 3.0 or higher GPA. If the prospective student does not have the 3.0 overall GPA or a 3.0 on the last 60 hours of course work, then the student must provide the GRE or MAT with an appropriate score. Legal 40 Mentoring Network

The Glasgow Legal 40 is an initiative designed for University of Glasgow School of Law Diploma students. The group comprises 40 successful University of Glasgow legal alumni, drawn from all sectors of the legal profession. The main activities of the group include a mentoring programme and a series of social and educational events which allow Diploma students to engage with distinguished members of the legal profession and which will benefit the next generation of lawyers to emerge from the School of Law.

Since 2013, the group has been strengthened and developed by the introduction of Glasgow Legal 40 associates. This involves students who benefited from support and mentoring offered by Glasgow Legal 40 members undertaking the same role for their successors.

Launched in September 2010, our programme aims to bridge the gap between academia and professional legal practice; the Glasgow Legal 40 is a unique and key initiative which allows us to achieve our goal of ensuring our students are not just employable, but sought after by employers. The Legal Practice Course (LPC) aims to prepare you for employment as a trainee solicitor and to provide you with a solid foundation for subsequent practice as a solicitor. This course can be studied full-time or part-time (day or evening). In the most recent (2014-15) Destinations of Leavers from Higher Education (DLHE) survey, 98.2% of graduates from this course were in work or further study within six months.

More about this course

This course provides graduates who have completed the academic stage of legal training with the professional stage of training required to qualify as a solicitor. We have a long-standing reputation for training solicitors and were one of the first universities to be validated to run the Legal Practice Course.

The course emulates the nature of the work encountered in practice and is transactional, following clients through various legal transactions and court hearings. It builds on the substantive law that you will have already learnt and includes the study of both law, and procedure in the major areas of practice. It also teaches the 'lawyerly' skills of practical legal research, interviewing and advising, writing, drafting and advocacy to prepare you for your subsequent professional training and for practice as a solicitor.

The LPC is entirely taught in a modern building with a mock court room, audio visual recording facilities, IT resources and library. Materials and case studies are provided.
-The LPC at London Met provides you with the required knowledge and skills that you will need to qualify as a solicitor.
-We offer work placements and pro bono opportunities to enhance your employment prospects.

Teaching is highly interactive and you will be taught in a small groups in three-hour sessions. The tutors are accessible and friendly and classes are supplemented with online tests and revision lectures and materials. The emphasis is on face to face teaching although some lectures, covering more complex subjects, are available online,. The overwhelming response from student feedback is that they prefer live contact with tutors and fellow students. You learn by “doing” on this LPC.

Students attending on either the one year full-time or the two year part-time LPC are required to attend an intensive foundation course for the first week of term in September from Monday to Friday, 10am until 5pm. Compulsory attendance is required for all students, irrespective of whether you are studying full-time or part-time. Please take this into consideration when arranging work, family and holiday commitments.

You can choose to have all your face-to-face tuition and workshops for the core practice areas concentrated into two set days a week on our one year course. This is usually Tuesday and Thursday from September until June. It enables you to reduce your travelling costs and plan your week. You attend an average of 12 hours face to face contact per week with the remaining time devoted to private study. Please note however, you may have to come into the university on additional days for assessments. Also Stage 2 elective subjects may run on different days.

Students who wish to complete the Legal Practice Course over two years can attend either in the evenings or during the day. The part time evening classes are taught from 6pm until 9pm on Tuesday and Thursday in the first year and Monday and Wednesday in the second year. The part-time day classes are taught from 10am until 5pm on Friday in the first year and on Monday in the second year.

Assessment methods are designed to reflect how solicitors work today, and include skills assessments and open book examinations.

Professional accreditation

London Metropolitan University is an SRA (Solicitor Regulation Authority) approved LPC provider.

The Law School at Ulster University has joined forces with Legal Island and the Labour Relations Agency to create what we think will be the best employment law course in the UK.

The course includes 24 employment law and compliance lectures from the cream of Northern Ireland’s employment law expert practitioners and on-site visits and role play exercises with LRA staff and the President of Industrial Tribunals and the Fair Employment Tribunal.

Employment Law

The importance of the employment relationship between employers, employees, unions and other statutory bodies and agencies is such that a thorough knowledge of both the context and the substantive law is necessary for those involved in this area in any capacity. The module attempts to provide the basis for this knowledge and to put students in the position where they may not only have an understanding of the law both conceptually and substantively, but also be in a position to use that knowledge in the solution of problems.

Alternative Dispute Resolution

Methods of ADR are increasingly being used within the legal system and advocated as a means of removing cases from overburdened courts. In appropriate cases they can provide an alternative to legal adjudication and can be used as a means of achieving satisfactory solutions to disputes. The purpose of this module is to introduce students to the processes of Alternative Dispute Resolution (ADR) and its relationship to law. The course will cover processes such as arbitration, mediation and conciliation and will provide students with a foundational knowledge of ADR which can then be developed in their professional practice. The module will comprise both theoretical and skills based elements. Students will consider the rationale and ethics of ADR before being introduced to some of the practical skills used in these processes. The study and practice of ADR will be undertaken in the context of a range of legal subject areas, including commercial law, family law and employment law.

Tribunal Representation

This module aims through a combination of lectures and practical exercises to enable trainees to further develop their own professional practice in relation to employment and social security matters. The module aims to develop a student's ability to apply and further develop the knowledge and practical skills gained in prior and concurrent modules. The module will encourage discussion of rationales and consequences of each available course of action in any given scenario, and students will be encouraged to critique solutions to any issues identified as arising from their choice(s). It is anticipated that students will examine the impact of the rules and procedures involved and their tactical application in practice with a view to developing their own individual work practice.

Employment Compliance and Development

Whether you are a lawyer, human resources professional, personnel or industrial relations officer, this module will develop a range of skills, which will enable all students to remain fully abreast of the latest legislative and case law developments in employment compliance. It will ensure that all students acquire in-depth knowledge and understanding of how employment compliance issues operates in practice. Students will be provided with assistance enabling them to respond to complex practical, legal and ethical problems. Students will be encouraged to critically analyse the law and important legal issues they face in practice.

The LLM Civil Litigation and Dispute Resolution offers you the opportunity to gain a recognised legal professional qualification as a Graduate Member of the Chartered Institute of Legal Executives (CILEx), and build valuable professional experience working as a volunteer in our Legal Advice Clinic.

You'll study the law, procedure and theory of civil litigation and related dispute resolution processes while also gaining practical legal experience and developing your professional skills. All students will take part in face to face, drop-in advice giving sessions at our Legal Advice Clinic and may have an opportunity to volunteer at our Lambeth County Court Help Desk.

Timetable

Full-time mode:
Two evenings and two afternoons per week (usually nine hours), plus clinical practice hours.

Part-time mode:
One evening and one afternoon per week (usually three to six hours), plus clinical practice hours.

Teaching and learning

All modules are supported by weekly online learning activities, resources and practical work, particularly in the Legal Advice Clinic, is supported by one to one feedback and support from experienced legal practitioners.

Placements

All students will work in the LSBU Legal Advice Clinic giving supervised legal advice to local clients at the clinic's weekly drop-in sessions. Students taking the Advocacy (Clinical) module will also take part in clinical activities based in the local courts.

Professional links

The course and the Law Department have strong links with Lambeth County Court, the Southwark Legal Advice Network and the South London Law Society. Advice sessions at the Legal Advice Clinic are supported by Solicitors from local South London law firms.

Employability

You'll develop your professional skills,experience and confidence alongside local legal professional practitioners. The LLM Civil Litigation and Dispute Resolution offers clinical legal experience and an embedded professional qualification (Graduate Member of CILEx), offering you the opportunity to start work as a qualified legal professional without further study on graduation.

Graduate Members of CILEx are entitled to become Fellows of CILEx after 3 years of legal practice. Fellows of CILEx are fully qualified legal professionals with the same professional privileges and responsibilities as Solicitors, but who are qualified to work within one specified legal practice area only. In the modern profession, most Solicitors are also specialists concentrating on one legal practice area only. The cost of the LLM is considerably less than the Bar Professional Training Course or the Legal Practice Course. Qualification with CILEx does not require a Pupillage or Training Contract, just the three years qualifying legal employment.
