Many public services are now outsourced and there is growing support from the Local Government Association to improve the contract management skills of those working in local authorities. You will focus on examples from your own workplace and analyse case studies to sharpen your ability to lead on new contract negotiations and manage relationships.

This one-year postgraduate course is designed to enable civil engineers and other suitable qualified professionals, such as architects and quantity surveyors and lawyers, to acquire a knowledge of construction law. The diploma is accepted by Engineers Ireland as fulfilling criterion no. 2 (Knowledge of Law and Contract Procedure) for admission to the IEI list of conciliators. This Diploma has also been approved by Engineers Ireland as meeting the requirements for continuing professional development. Accreditation has also been given for Part II status of membership of the Chartered Institute of Arbitrators.

Course Organisation:

Lectures are normally held on Friday evening 7 - 10 p.m. and Saturday morning 9.30 a.m. - 12.30 p.m. each week throughout the two semesters (September to April). In addition to attending lectures, participants are required to participate in workshops, which comprise a major part of the course and involve coursework to be submitted as part of the students' assessment.

You will develop your professional skills to be able to interpret contracts and appreciate the controversies surrounding commonly used standards forms of construction contracts. The Legal Practice Course (LPC) offers intensive, post graduate-level studies to those who wish to qualify as a solicitor in England and Wales. To become fully qualified after completion of the LPC, you will need to undertake a two-year training contract, which is a period of recognised work-based training.

The LPC will ensure that you acquire the skills, knowledge and attitudes to prepare you for the start of the training contract, equip you to deal with the demands that are likely to be made of you in practice and lay the foundation for your future practice as a solicitor by encouraging habits of competence, confidence and professionalism.

In addition, the LLM Legal Practice Course will also prepare you for a research module submission and allow you to reflect on the challenges facing the legal profession in today’s world.

Learning and assessment

How will I be taught?

Teaching is conducted in large and small group lessons. Large groups take the form of lectures to all students and each large group lasts one hour. Most large group lessons are delivered live and are scheduled on the timetable, but some large groups are pre-recorded.

Small group teaching will be timetabled in groups of up to 16-18 students although you may be organised into smaller groups for the purpose of some lessons. Small group lessons are usually scheduled to take place for two hours, although some may be up to three hours duration. Attendance at small group sessions is compulsory.

A distinctive feature of the LPC is that a substantial part of the time devoted to classroom practice overall will involve students in the exercise of the Course Skills.

You will be given an introduction to legal research during terms one and two which will assist you in preparing for the research module. Seminars will be held in the third (electives) term to cover further and more detailed matters. Supervision of the research module will also begin in the third term.

Within the curriculum, you will develop your ability to undertake independent learning and team-working skills. Communication skills are developed in small groups, where you will be required to work collaboratively on problems and tasks. The emphasis on the course is on the application of legal knowledge to simulated factual situations, giving advice to the client and undertaking tasks according to the client’s instructions.

The LPC is a practical course and you need to analyse the facts to identify the relevant issues on which the client needs advice; identify the relevant law and procedure; apply the relevant law and procedure to the relevant facts and advise the client, clearly and fully, taking into account the rules of professional conduct and the commercial and business needs of the client. 

Outside the curriculum you will have the opportunity to develop wider “employability” skills through participation in the school’s Law in Action pro-bono schemes run with partner organisations, in which student volunteers assist real people in their dealings with the law. The schemes currently include: 

  • Law in Justice: the Innocence Project, (dealing with alleged miscarriages of justice);
  • Law in Healthcare: the NHS Continuing Healthcare Scheme, (challenges to NHS healthcare funding assessments);
  • Law in Sport: the Rugby Union Project – (providing legal advice and legal newsletters to rugby clubs).

Other activities in the Law School include mooting, negotiating and client interviewing competitions.

How will I be supported?

Your learning will be supported through e-learning; all modules are supported by Learning Central, a virtual learning environment that is available on and off campus through which you will access a wide range of materials for your modules. We provide most of the lesson materials in electronic form as well as in hard copy. We also make available recordings of large group sessions shortly after each session is delivered and students can access these recordings via Learning Central.

Society continues to value and shape the built environment resulting in both public and private investment in construction assets and the successful completion of construction projects. As these projects become more socially and technically complex in a changing world dominated by a concern for sustainability, there has been a growing challenge to develop existing and new skills and expertise in construction project management. This challenge is not only national but global as the need for construction project management skills continues to grow internationally. Indeed, our student cohorts reflect this global challenge with students from across multiple continents.

We have been running programmes in MSc Construction Project Management for nearly 20 years. This arose from the need to extend the managerial remit to those activities that fall outside the construction phase to include areas such as financing, design and hand-over. The programme is therefore tailored for construction professionals looking for a more holistic perspective of construction project processes and the challenge of project management in complex building and infrastructure projects.

Students will gain a sound understanding of macro, meso and micro economics and types, sources and management of finance relating to construction organisations and projects. - Federated 3D Building Information Modelling (BIM)
The creation, deployment and use of aggregated and integrated models are key goals of collaboration through BIM. This module aims to deliver hands-on practical skills on the use of BIM technologies (i.e. design software and collaboration tools) for real-time co-creation and data sharing of federated/aggregated 3D BIM models. The concept of shared situational awareness within design teams/processes will be explored.

Scholarships and bursaries

The University offers over 100 scholarships each year to new self-financing full-time international students who are permanently resident in a county outside the European Union. Our LPC course will prepare you for life as a practising solicitor in England or Wales, and allow you to continue on to the two-year training contract that will fully qualify you for professional practice*.

You will most likely choose to complete your two-year training contract with a firm of solicitors in private practice, but might prefer to take one with an alternative employer, such as the UK government (through the Government Legal Service), local government, the Crown Prosecution Service or a law centre. Case studies and contemporary issues figure prominently in the programme, particularly focusing on the lessons to be learnt from the recent ‘credit crunch’ and the issues for international financing and regulation that this has thrown up.

Compulsory modules:

Organisations and People: This module examines key issues arising from contemporary research in organisational behaviour (OB) and human resource management (HRM). It provides an integrated analysis of management, organisations and people, developing the conceptual, strategic and practical skills necessary for managers in complex, global organisational contexts.

Management Research: This module analyses the philosophical basis for research in the management sciences, and examines a number of key methodological issues and approaches. Research designs for both quantitative and qualitative research methodologies are developed, including interviews, case studies, focus groups, surveys and experiments.

Bank Financial Management: This module provides a grounding in the nature, strategic context and managerial functions of financial management in banks and other financial services firms. Three key themes are: identification and management of the trade-off between risk and return; improvement of a bank’s value using market models; and external market-based tests of bank performance.

International Banking: This module examines the origins of international banking, the activities of international banks, the markets in which they participate, and the sources of risk. You will investigate the determinants of the efficiency of international banks, and evaluate the implications for banks’ strategic decision-making.

Financial Institutions Strategic Management: This module examines the main theoretical and practical issues concerning banking business. You will develop a critical awareness of the theory of the banking firm, the motives for international banking, and regulatory and structural issues impacting on bank behaviour.

International Banking and Capital Markets Law: This module will provide a sound understanding of the law and practice of modern international banking, including the regulation and prudential supervision of banks in the UK and EU in the areas of capital adequacy and risk management.

Optional modules (choose 2):

Comparative Corporate Governance: Major corporate scandals in the US, Europe and the UK in recent years have raised questions about the organisation and governance of companies, in particular large multinational organisations. The growth of private equity buy-outs has also raised issues of transparency and accountability.

Credit and Security Law: The supply of credit is the lifeblood of industry but of course a lender will require security. This module will examine in detail the provisions relating to the regulation of the supply of credit to consumers and business.

International Corporate Finance Law and Merger Regulation Law: This module focuses on the study of leading case law and selected legislation, relating to international mergers and their financing from several common law countries such as the USA, Britain, Ireland, Canada, Australia and New Zealand, as well as China, India and the EU.

International Commercial Arbitration: This module considers the theoretical and institutional structure of arbitration and alternative dispute resolution, examines the legal framework within which disputes are resolved and reviews the practice of international commercial arbitration.

Consumer Law: This module focuses on the main areas of legal liability and the pitfalls that can arise if an organisation does not comply with the relevant consumer protection rules both in the UK and Europe.

Intellectual Property Law: This module addresses the fundamentals of intellectual property law, the definition and scope of copyright; the authorship, ownership, duration and qualification for copyright protection.

Competition Law: This module focuses on the theory and law of competition, focusing on UK competition law, and EU competition law relating to the control of restrictive practices, vertical and horizontal restraints and abuse of a dominant position. Comparative regimes, in particular that of the US, are examined.

Industrial Property Law: This module examines the history and development of industrial property law in the UK, EU and internationally. It covers the law relating to trade secrets, patents, copyrights, design rights and trademarks.

World Trade Law: This module studies aspects of the regulation of international trade through the General Agreement on Tariffs and Trade (GATT) and the World Trade Organisation.

International Insurance Law: Insurance plays an important role in commerce and risk management. Insurance contracts are governed by the rules of general law of contract. The module explores the nature and scope of the contract of insurance, considers the general principles of insurance, and examines the relationships between parties to a contract.

International Taxation Law: This module studies the basic principles of income taxation of international transactions involving taxpayers of several European countries (including the UK, the Netherlands, France, Germany, Ireland), the US, Australia, Canada and Japan.

Employment Law: Modern employment law is complex, and imposes major compliance costs on employers. This module covers contract of employment, minimum wage legislation, discrimination against employees, and unfair dismissal actions before Employment Tribunals.

International Environmental Law: This module focuses on internationally recognised principles and values concerning environmental protection, and how they are translated into legally enforceable tools. Methods of environmental regulation are analysed and compared.

You will be taught by staff from a wide range of commercial, construction and quantity surveying practice, including quantity surveyors, architects, project managers, construction lawyers and structural engineers. Their hands-on experience is reflected in the modern and diverse nature of this course, which provides you with a flexible degree programme that allows you to tailor the course to your own interests, whilst acquiring a range of skills and experiences that will be of direct benefit in the workplace.

Here are the units you will study:

Construction Law, Contracts and Dispute Resolution: This unit provides a systematic understanding and critical awareness of the background to and working of the legal system in England and Wales relevant to the practice of a quantity surveyor.

Construction Management and Safety: This unit will prepare the student for the commercial environment of construction and will develop a critical awareness of the commercial and environmental context within which the Project Manager operates.

Construction Technology, Measurement and Tendering: This unit provides a comprehensive understanding of how buildings and their services are designed and specified in order to formulate an Architect's or Structural Engineer's intentions.

Pre-Contract and Post-Contract Quantity Surveying Practice: This unit will provide a systematic understanding of the pre-contract and post-contract roles of the Quantity Surveyor.

Dissertation: There gives you the chance to carry out and complete an independent dissertation project during the final stage of the course. You will be able to choose a subject area of particular personal interest, within the broad scope of the built environment.

Programme Assessment

The classroom element of teaching will be via lectures, seminars and tutorials. However, the very nature this course requires a proactive and hands-on approach to learning that also incorporates site visits and field work.

Alongside the more traditional forms of assessment, this course is assessed in a variety of different ways that will provide you with valuable skills and experience in activities such as teamwork, report production, making presentations and web authoring. You will also be expected to complete a dissertation project, in a subject of your own choice, which will be developed and conducted with the advice and guidance of a personal tutor.

Student Destinations

Once you have completed this course and obtained your first job, you can begin training to become a Chartered Surveyor with a professional qualification. This is known as the Assessment of Professional Competence (APC) and is a structured on-the-job training scheme ending with an assessment interview. Once you have satisfactorily completed this, you can apply to become a member of the Royal Institution of Chartered Surveyors (RICS). This enables you to use the designated status Chartered Surveyor and the letters MRICS after your name.

The course consists of a series of 18 evening lectures held weekly starting at 6.30 pm on Wednesdays. During the course, students are tutored on a one to one basis in the preparation of their 10,000 word Case Study, their 2,000 word Career Evaluation and their PEDR (the professional experience development record), monitored by the part 3 course director.

The part 3 course is validated by the RIBA, and prescribed by the Architects Registration Board. Appropriately qualified candidates who pass the part 3 Professional Practice Examination (and have a minimum of two years eligible professional experience) are eligible to apply to the Architects Registration Board to register as architects, and join the Royal Institute of British Architects as a chartered member.

Candidates who do not have a recognised Part 2 in Architecture may wish to do the taught course as a CPD activity, and improve their knowledge of professional practice in the UK. In this instance, they will not be eligible to apply for RIBA part 3 examination.

Modules

The course starts with an eighteen week evening lecture course supplemented with tutorials, case-study seminars, and study groups.

This course aims to prepare architecture students who have RIBA part 2 ( and with adequate professional experience) coming forward to the RIBA part 3 Professional Practice Examination. The Professional Practice course covers salient and significant areas of the Professional Practice syllabus recommended by the RIBA including; current building legislation, planning, contract law, types of building contract, the management of architecture, practice and construction, financial control, business management, professional liability, and dispute resolution.

Four weeks before the written examination there is an examination preparation seminar to guide students for the examination and by ‘playing the contract game’ acquaint them with the workings of a JCT contract.

Professional accreditation

Successful completion of the course and passing all parts of the RIBA part 3 Professional Practice Examination enables candidates to register with the Architecture Registration Board (ARB), and join the RIBA as a chartered member. The course is prescribed by the Architects Registration Board (ARB).

Employability

The Professional Practice course is suitable for candidates who wish to prepare for the RIBA part 3 Examination or for those who wish to gain a greater understanding of professional practice as it relates to architecture as part of a CPD Programme. To reiterate, candidates who wish to undertake the course as a CPD activity will not be permitted to sit the part 3 examination.
