Yet evidence would suggest that companies do not readily understand the nature of these legal assets nor manage them in an effective commercial manner, such that they are sometimes described as the ‘hidden assets’ of a business looking to operate in today’s global market place. Students following this LLM in Intellectual Property and Commercial Practice will gain an in-depth legal knowledge of issues and the practical skills acquired will make them an invaluable asset to international commercial organisations.

Key Features of Intellectual Property and Commercial Practice

The LLM in Intellectual Property and Commercial Practice requires commitment to study throughout one calendar year. Students are given the opportunity to develop a number of important skills which are not only essential to those wishing to become lawyers but are valuable, transferable skills in themselves in other employment contexts. The Department of Shipping and Trade Law offers its students dedicated resources, including IT facilities and teaching rooms. Students of the Intellectual Property and Commercial Practice programme are fully supported by the College's dedicated Law Librarian and the Law Library holds an extensive selection of legal materials and on-line services such as Lexis and Westlaw. Students are encouraged to make full use of the facilities offered by the Shipping and Trade Law Department and, in particular, to take advantage of training sessions run by the Department, such as the legal research methods and Employability sessions, as well as of the Visiting Lectures’ series.

Modules

The LLM in Intellectual Property and Commercial Practice degree is modular, with students required to accumulate 180 credits to graduate. In appropriate circumstances, a student of LLM in Intellectual Property and Commercial Practice may graduate with a merit or distinction. Each programme is divided into two parts: Part I consists of 4 taught modules each weighted at 30 credits. Students undertaking an LLM in Intellectual Property and Commercial Practice are required to take four modules from the following list. It is compulsory for students on the LLM Intellectual Property and Commercial Practice to study Law of Intellectual Assets Management and Transactions. Students will also be required to take 3 modules from the rest of the modules listed below:

Following the successful completion of the taught modules, LLM in Intellectual Property and Commercial Practice students proceed to Part II, which is composed of two projects (LLM Research Projects). At least one of the LLM Research Projects must be written in the area of the Law of Intellectual Assets Management & Transactions. The LLM Research Projects will customarily be researched and written up over the summer period and are designed to enable LLM in Intellectual Property and Commercial Practice students to develop their research skills.

The Department also enjoys close links with law firms. For example, Associate Professor Andrew Beale OBE is a consultant with Capital Law and offers legal advice on IP matters. The Swansea LLM is well known internationally. Many of our graduates secure employment shortly after completing their degrees. This course is intended for non-surveying graduates working, or intending to work, in property development and related fields for public authorities, commercial organisations, property or construction companies, and private practice firms.

This course will provide you with the knowledge and skills enabling you to offer specialist advice in the field of property development. On completion you'll be able to offer a broad range of expertise, harnessing your first discipline with the theories, practices and techniques of the planning and development surveyor.

Extensive use is made of outside speakers many of whom are drawn from our own alumni; some of whom have successfully established their own property development companies.

- Institutional and legal context for property
This module focuses on introducing students to the various areas of law and issues of professional practice used and applied in the construction and property industries.

- Construction and planning
A module to provide a broad and critical perspective on planning and construction, as well as an understanding of the context within which planning and construction decisions are made and implemented.

- Valuations
This module is intended to allow the theoretical knowledge gained in a series of lectures and workshops to be applied in practice. The module will consider the fundamental principles of valuation, valuation formula and discounted cash flows. It will examine the methods used in the valuation of office, retail, industrial and residential properties. The module will also introduce the process of development and redevelopment of property.

- Applied valuations and the management of property interests
This module gives a practical insight into managing property. The roles and responsibilities of both landlords and tenants are considered in property management. Financial calculations that inform property management decisions are also considered.

- Economics for property professionals
This module provides an introduction into a set of theoretical and practical principles that enable property professionals to develop, manage and grow successful businesses.

- Property development process
This module provides a broad and critical perspective on property development and an understanding of the context within which property development decisions are made and implemented.

- Project finance
This module provides the necessary skills and knowledge for project funding, project evaluation and management in the property industry.

- Planning law and practice
This module examines the history of planning and the evolution of the theories, ideas and practices that have underpinned its attempts to intervene in the natural and built environment.

- Dissertation
The module provides the opportunity for students to undertake an independent piece of research, investigating in depth a subject, in which, they have a particular interest and of their own selection. Each student will submit a dissertation of between 15,000- 20,000 words. The module includes teaching of research methods.

The module develops a comprehensive understanding of the decision-making process in any real estate decision and it transition mechanism to market prices.

- Building control
The module focuses upon the control and enforcement of the Building Regulations and associated legislation, along with supporting technical documents and alternative solutions, to meet specific regulative requirements as they apply to various building schemes.

- Building information modelling and collaborative working
A module to provide a general understanding of the role that BIM can play throughout the design, construction and operation of building assets. It looks to identify and develop the necessary managerial, technical and interpersonal skills required to deliver better value through a collaborative BIM approach.

- Health and safety management in construction
This module focuses on the management of safety on site – a process that can be applied to a wide range of work settings and project types.

- History of architecture and construction
This module examines the inter-relationship between building design and production as it occurred throughout historical time. Particular attention will be paid to those periods in history when major transformations occurred in architectural style and the building process. Other historical themes will also be pursued.

- International real estate and construction
This module introduces students to the international context of real estate markets, construction industry and project development. It specifically focuses on the activity of international real estate investors and large construction companies. The module also provides students a comparative perspective on real estate markets and construction process.

- Legal resolution of property and construction disputes
This module focuses on the range of dispute resolution techniques used by construction and property professionals to resolve and manage disputes in the construction and property industries.

On completion of the course you will be able to offer a broad range of expertise, harnessing your first discipline with the theories, practices and techniques of the planning and development surveyor.

The Legal Practice Certificate programme produces highly skilled, commercially aware and effective Trainee Solicitors, who are prepared for the rigours and demands of a Training Contract.

The LLM in International Commercial and Maritime Law degree is modular, with students required to accumulate 180 credits to graduate. In appropriate circumstances, a student of the International Commercial and Maritime Law course may graduate with a merit or distinction. Throughout their studies, LLM in International Commercial and Maritime Law students are provided with the opportunity to take part in a number of extra-curricular activities and enhance their practical understanding of shipping, insurance and commercial practice. Such activities include;

Careers & Employability

The International Careers Adviser at Swansea runs weekly workshops for international students, for example, on how to improve career prospects and improve interview techniques. The Postgraduate Department also employs two dedicated LLM employability officers who run a series of talks to develop the skills of LLM students and inform their career plans.

The Department also enjoys close links with many City law firms. For example, one of our professors on the LLM programme was a senior partner, and is now a consultant with, Ince & Co, a leading London law firm, specialising in international trade, insurance and shipping law. The IISTL provides training programmes for London City solicitors, P&I Clubs and shipping organisations. Many of our graduates secure employment shortly after completing their degrees. Several international firms keep a close relationship with the Shipping and Trade Law Department and regularly send representatives for guest lectures and graduate recruitment purposes. LLM in Commercial and Corporate Law deals with the global and regional regulation of international trade, structuring and managing international business transactions, and the economic foundations of trade and corporate law.

Professional Module Exemptions

The Chartered Banker Institute (CBI) has recognised masters programmes offered by the School of Economics and Finance for advanced standing for the Chartered Banker Diploma. Graduates can proceed directly to the Chartered Banker Diploma with no requirement for prior underpinning study, recognising the high level of commonality of elements within LLM programme content against the CBI’s Diploma modules.

Students on the LLM programme who take both the QLLM136 Ethics in Business and in Finance and QLLM007 Banking Law modules will be eligible for exemption from the Chartered Banker Diploma compulsory module: Professionalism Regulation and Ethics.

The core subjects of the programme are intended to equip students with both an advanced knowledge of substantive intellectual property law and of the place and role of intellectual property within a domestic, regional and international context, laying a foundation for a specialised dissertation.

The programme spans comparative study of the laws of patents, copyright, trademarks, designs, database protection, breach of confidence, passing off and related sui generis rights, as well as investigating a range of issues which underpin contemporary intellectual property law.

The programme allows students to explore intellectual property law not just in its legal but also social, ethical, cultural and commercial contexts.

Format

We teach two modules each week, over four hours of teaching time. In addition, students will complete a 15,000 word dissertation, which will be supported by a Research Methodology module.

Assessment

The taught modules adopt a standardised and consistent approach. In each of these modules, there will be a formative assessment, which will not count towards your final module mark. Following this, there will be two assessments – a piece of coursework of 3,000 words and an end of semester (pre-release) exam. Both will count towards your final mark. Normally, you will receive feedback within two weeks of submitting coursework and within three weeks of sitting exams.

During recent decades property development has become a more complex process. The need to adapt to economic change, evolving funding mechanisms, legal developments, technological change, and political and environmental issues pose challenges for the property professional.

We offer optional study days in the Law School to help distance learning students get the best out of the course. Panopto software will be used to record teaching activity taking place on study days and the footage will be made available online, meaning that you can learn at your own pace and at times that suit you.

Research-Rich Learning

Research rich learning (RRL) is embedded through the course. Law School research focuses on the areas of Law and Society, Legal Education and Professional Skills, and the Centre for Evidence and Criminal Justice Studies. These internationally recognised groups act as a focus for research activity across the Law School, and their work feeds into the courses to ensure content is informed by research developments in the sector.

The LLM culminates in the project module in which you will undertake a piece of independent legal research, informed by current practice and advanced scholarship and research, including a critical awareness and evaluation of current issues and developments in the field.

The LLM is designed to enhance your employability in the international commercial law arena. You will be encouraged to reflect upon your own practice, applying legal skills to the common problems you are experiencing or are likely to experience in practice, examine policies and undertake independent legal research to update your knowledge. The first stage of this RICS accredited course will introduce you to key concepts and frameworks related to built environment disciplines. The second stage is specific to real estate and will develop your ability to value commercial property, manage property assets, analyse property market data, evaluate property proposals, ensure compliance with planning policy frameworks, and acquire sites for building.

The final stage will be a master’s dissertation that investigates an aspect of how real estate professionals operate in complex and unpredictable environments.

The course is accredited by the Royal Institution of Chartered Surveyors (RICS), which is a reflection of its relevance and quality and meets the academic requirements for membership.

Internationally focused modules cover key concepts in real estate. They include planning and development, property valuation, investment, management, sustainability and legal processes. Some modules are assessed via traditional assignments and project reports, but where appropriate we use methods relevant to industry such as presentations, report-writing and mock client meetings. The course culminates in a 20,000 word dissertation in a related specialist area of your choice. There are no examinations for this course.
