Mediation is developing at great speed in many countries. For example, it is part of the civil justice system of England and Wales through the Civil Procedure Rules and the provisions in the rules which encourage the use of mediation. Additional government initiatives in England and Wales have been introduced such as automatic referral to mediators for small claims court matters.

In Europe, the EU Directive on Cross-Border Mediation has led to the implementation of mediation legislation throughout the EU. Beyond Europe, other developments continue: for example, Japan has introduced mediation in its financial services sector; Hong Kong is promoting mediation through new legislation protecting confidentiality of the process; the International Bar Association has drafted investor-state mediation rules; Nigeria continues to develop its multi-door courthouses through which mediation is a primary process.

The Postgraduate Distance Learning Diploma in International Dispute Resolution - Mediation has a strong focus on mediation and conciliation. The course will introduce you to the process of mediation and its role in the resolution of disputes. The diploma not only provides an understanding of the theoretical, practical and ethical problems relating to international mediation, but can also provide a stepping stone for professionals to become involved in international alternative dispute resolution (ADR).

The diploma is aimed not only at lawyers, but also at other professionals who may be involved in mediation - be it as a disputant, representative or perhaps as a mediator: a legal qualification will not be a prerequisite for admission, although you will be expected to appreciate that the course will involve an understanding of law and legal implications. References and materials will be legally orientated, but this will enable the non-lawyer to be better equipped to deal with the issues raised in international business mediation.

This programme will:

Why is the course relevant?

Mediation is developing at great speed in many countries. For example, it is part of the civil justice system of England and Wales through the Civil Procedure Rules and the provisions in the rules which encourage the use of mediation. Additional government initiatives in England and Wales have been introduced such as:

A pilot scheme for the automatic referral to mediation in the UK County Court Money Claims Centre for claims of less than £5,000.
Automatic referral to mediators for small claims court matters (claims up to £5,000).
A Court of Appeal scheme whereby appeals of personal injury and contract claims of up to £200,000 will be automatically recommended for mediation.
The Department for Business, Innovations and Skills has instituted a pilot scheme for two regional mediation networks for small and medium sized enterprises.
In Europe, the EU Directive on Cross-Border Mediation (2008/52/EC) has led to the implementation of mediation legislation throughout the EU. Beyond Europe, other developments continue: for example, Japan has introduced mediation in its financial services sector; Hong Kong is promoting mediation through new legislation protecting confidentiality of the process; the International Bar Association has drafted investor-state mediation rules; Nigeria continues to develop its multi-door courthouses through which mediation is a primary process.

Programme structure

You can study the Postgraduate Distance Learning Diploma in International Dispute Resolution - Mediation, part-time for a period of 18 months, starting in January each year.

The year is divided into two seven-month terms, with a selection of optional modules and dissertation being offered during the second term.
◦Taught modules (22.5 or 45 credits). Each module requires around seven and a half hours of work a week over one term. Each module assessment will vary and consist of assessed tasks, a module essay and final assessment exercise (take-home exam).

The programme is taught by a team of professionally-qualified experts who are the authors of the BPTC manuals in use across the country. Internationally renowned and highly skills focused, City’s BPTC provides a bridge between academic legal study and professional practice and covers three essential areas:

Underpinning all of these areas is a foundation of analysis and legal research, combined with the need to set priorities and organise your work in order to meet deadlines.

Placements

Placements are not a formal requirement of the programme, but we encourage you to spend time in chambers doing mini-pupillages.

Pro bono is an opportunity to use your time and knowledge to provide legal advice to those who may otherwise not have access to such services. It provides you with invaluable experience and a chance to develop your legal skills further. At The City Law School you will have the opportunity to work with one of our pro bono volunteering organisations that needs assistance.

Mooting is a great way to develop important legal skills such as research and analysis whilst also learning how to structure a legal argument. At The City Law School, we run an annual internal mooting competition where students act as a counsel to argue a point of law before a judge.

Academic facilities

The Bar Professional Training Course is taught at Gray’s Inn Place campus. Here you will find the Atkin Building which houses the student common room and the large lecture theatre and teaching accommodation. The library, computer study areas and additional teaching accommodation are located in two nearby buildings.

The City Law School has its own dedicated administration team and its own online legal resource portal - Lawbore. You also have access to two legal libraries, one on site at the Gray’s Inn campus and one based at our Northampton Square campus.

Within the Gray’s Inn library you will find areas for group study and a room to record advocacy performances. There is a large suite of recording rooms nearby. You will also receive copies of the textbooks used on the course. These include:
-Practitioner books in civil practice and criminal practice.
-The City Law School BPTC manuals (published by OUP as the "Bar series").
-Textbooks in civil procedure, evidence and alternative dispute resolution.

Teaching and learning

Most of the course is taught in small groups where you will be studying with 12 other students, and in classes of six students for advocacy. You will also learn through one-to-one tuition in the advocacy skills part of the course.

Debating, mooting and mock trials also prepare you for pupillage interviews.

We also train students on how to give peer feedback and conduct client conferences, where you give an oral performance which is recorded for feedback. You also have the opportunity to cross-examine mock witnesses and clients in real time as part of the programme’s final assessment.

You will be assessed under examination conditions in the written skills and the knowledge-based areas of ethics, civil procedure and criminal procedure. You will also be assessed through replicated scenarios, which we would expect you to encounter in practice.

Teaching is supported by a range of materials, including a series of skills and subject manuals written by senior members of staff and members of the practising Bar. These manuals are published by Oxford University Press, have been adopted by other providers, and are widely recognised as leading and innovative texts on teaching legal skills. The course is also supported by a wide range of written and electronic resources.

Modules

Modules in the first two terms are compulsory (and are based on the Bar Standards Board requirements), and you can choose two options from 11 topics in the third term.

The course has been developed to give you the relevant legal skills and knowledge that all newly qualified barristers need, along with the detailed knowledge you will need for your chosen specialist areas/subjects. While there is a strong focus on advocacy, advisory and drafting skills are also important as well as knowledge of court procedures and evidence and the principles governing ADR and professional ethics. Three of the option subjects (FRU, domestic violence and social security) are pro bono based, which gives you the opportunity to get real-life experience as part of the programme.

There is a strong focus on preparation, participation and practice. Students are encouraged to recognise that work on the programme is set in a realistic context and to approach the work in a professional, ethical, practical and problem-solving way.

The range of options offered in any one year is subject to availability and demand, but we usually run all 11 options. The same range of options is offered to part-time BPTC students as to full-time ones, but subject to demand, some may only be delivered during the day.

Career prospects

Training for the Bar is a serious proposition because of the responsible role played by barristers in the administration of justice. It is also one of the most sought after and respected careers available. On successful completion of the course you will receive the Postgraduate Diploma in Professional Legal Skills and be eligible to be Called to the Bar of England and Wales by your Inn. At that stage you are entitled to describe yourself as a barrister, but will not be entitled to represent clients in court until you have completed the first six months of pupillage.

Pupillage is usually for 12 months, and is usually taken in one set of chambers, although sometimes pupillage takes place in two or more sets.

Minimum pupillage awards for the first year are £12,000. Some pupillage awards exceed £60,000. Tenants earn more than pupils.

The Civil Litigation and Dispute Resolution LLM degree should interest and benefit a broad range of students. This Specialist LLM in Civil Litigation and Dispute Resolution programme provides a unique opportunity to enhance the development of a career in legal professional practice as a barrister, solicitor or other qualified legal practitioner. This innovative specialist Masters degree is designed to provide a sound understanding of the rules under which litigation, arbitration and mediation operate, based on current scholarship including areas such as procedure, evidence and ethics.

Teaching and learning

This course is taught by leading academics as well as visiting practitioners including barristers and solicitors who work in private practice and in legal departments of major companies.

All modules are structured as 10 weekly two-hour seminars which comprise both lectures as well as interactive tutorials. All modules are supported by our online learning platform Moodle.

Assessment

Assessment is by way of coursework which comprises 100% of the final mark in each module. Each module carries the same weight in terms of the overall qualification.

You will be allocated a dedicated supervisor for your dissertation who will help them develop a specific topic and provide support in terms of resources, content and structure.

Modules

As with all LLM specialisms at City, University of London, you may take either 5 modules and a shorter dissertation (10,000 words) or 4 modules and a longer dissertation (20,000 words). All modules are of the same duration and are taught per term (September – December or January – April) rather than the whole academic year. If you take 4 modules you will take 2 per term in each term and if you take 5 modules you will have 3 in one term and 2 in the other. Dissertations are written during the summer term when there are no classes.

In order to obtain this specialism, you must choose at least three modules from within this specialism and write their dissertation on a subject within the specialism.

All students will work in the LSBU Legal Advice Clinic giving supervised legal advice to local clients at the clinic's weekly drop-in sessions. Students taking the Advocacy (Clinical) module will also take part in clinical activities based in the local courts.

Professional links

The course and the Law Department have strong links with Lambeth County Court, the Southwark Legal Advice Network and the South London Law Society. Advice sessions at the Legal Advice Clinic are supported by Solicitors from local South London law firms.

Employability

You'll develop your professional skills,experience and confidence alongside local legal professional practitioners. The LLM Civil Litigation and Dispute Resolution offers clinical legal experience and an embedded professional qualification (Graduate Member of CILEx), offering you the opportunity to start work as a qualified legal professional without further study on graduation.

Graduate Members of CILEx are entitled to become Fellows of CILEx after 3 years of legal practice. Fellows of CILEx are fully qualified legal professionals with the same professional privileges and responsibilities as Solicitors, but who are qualified to work within one specified legal practice area only. In the modern profession, most Solicitors are also specialists concentrating on one legal practice area only. The cost of the LLM is considerably less than the Bar Professional Training Course or the Legal Practice Course. Qualification with CILEx does not require a Pupillage or Training Contract, just the three years qualifying legal employment.

The core module, Alternative dispute resolution, interprets the subject as a truly interdisciplinary field comprising of law, social science, economics, psychology and others. This is a newly emerged and vibrant area of scholarship, hence it is impossible to give yes or no answers to most of the questions. Accordingly, the module will employ critical thinking and an open discussion approach. It is expected that you will be willing to share results of your research and be involved in active discussion of all issues.

There are two distinct International Dispute Resolution diploma routes to choose from, Arbitration or Mediation.

Society continues to value and shape the built environment resulting in both public and private investment in construction assets and the successful completion of construction projects. As these projects become more socially and technically complex in a changing world dominated by a concern for sustainability, there has been a growing challenge to develop existing and new skills and expertise in construction management. This challenge is not only national but global as the need for construction management skills continues to grow internationally. This particular programme benefits from being rooted in a long 40 year history of delivery. We have been running programmes in MSc Construction Project Management for nearly 20 years. This arose from the need to extend the managerial remit to those activities that fall outside the construction phase to include areas such as financing, design and hand-over. - ICT for Construction Projects
This module introduces managers to a wide range of tools and technologies appropriate for their role and projects. The module covers a range of topics including project information flows, e-business, database technologies, emerging technologies, building information modelling technologies, groupware and collaborative systems.

- Research and Communication
The aims of this module are to provide the student with an overview of sources of information in construction; to explain to students how to conduct a literature review and introduce students to the principal methods of investigation in construction research; and provide an opportunity for each student to develop professional and academic skills in oral and written communication.

- Principles of Design and Construction
This module teaches students the fundamental principles of managing a project during the design and construction phases. The module develops knowledge and understanding of the role and principles of the estimating, tendering and planning of construction projects and the importance of health and safety in relation to design and construction activities.

- Principles of Project Management
Students will gain an understanding of construction project management principles and theory. Specific areas covered include management responsibility for running construction projects; contemporary issues facing the construction industry; cultural complexity and the impact of behaviour and motivation on performance; and applying appropriate project management techniques for the different project phases.

- Design Management
This module introduces various Design Management techniques and approaches. These include process mapping techniques for design; ways to analyse and optimise the design process; and students will gain an understanding of the internal workings of a design office and their relationship with the construction team.

- Sustainability and the Built Environment
Students will gain an understanding of sustainability issues that relate to the built environment; ways in which these issues can be managed and effective communication of both strategic and technical information.

- Management of Construction Processes
This module introduces students to cutting edge contemporary management concepts and innovations; complexities of setting up and managing logistics on large construction sites; and essential project management techniques such as risk management.

- Postgraduate Research Project
The aim of this module is to provide the student with experience of the process and methodology of research by defining and studying (on an individual basis) a complex problem in a specialised area relating to Construction Project Management.

- Procurement and Contract Procedure
This module aims to develop students understanding of procurement methods, different forms of contract and contract practice. The module is designed to give students key practical skills including advising clients on appropriate procurement and tendering methods; selecting the most appropriate form of construction contract; and manage a construction contract effectively.

- Business Economics and Finance
Students will gain a sound understanding of macro, meso and micro economics and types, sources and management of finance relating to construction organisations and projects. This will allow students to analyse the policies and operations of construction organisations and projects from an economic perspective to determine likely performance consequences and analyse corporate financial data for investment prospects and business management decisions.

- Federated 3D Building Information Modelling (BIM)
The creation, deployment and use of aggregated and integrated models are key goals of collaboration through BIM. This module aims to deliver hands-on practical skills on the use of BIM technologies (i.e. design software and collaboration tools) for real-time co-creation and data sharing of federated/aggregated 3D BIM models. The concept of shared situational awareness within design teams/processes will be explored.

Previous students have gone on to work for a variety of organisations nationally and internationally. These include Arup, Atkins, BAM Nuttall Ltd, Balfour Beatty, Kier Group, Morgan Sindall, Skanska and Transport for London. Our aim is that the Glasgow Diploma comes to be regarded as the trademark of excellence, ensuring that you are not just employable but actively sought after by employers. Programme structure

You will take five core and three optional courses. The core courses are required by the Law Society of Scotland, which regulates Scotland’s legal profession. Optional courses allow you to select additional subjects of study that suit your areas of interest or meet the requirements of your future employers in the legal profession. Courses are delivered through a combination of online resources, e-modules, lectures and small group tutorials. As our programme aims to equip you with the abilities and attributes of a “day one ready trainee”, each course will enable you to develop not only your written communication skills, but your verbal communication skills. Tutors will expect you to come to each class prepared to contribute.

Format

This course is suitable for the working professional as it is taught online, by distance learning. The flexible structure of the course allows a choice of study routes depending on discipline and professional needs. The vocational nature of the course allows the graduate to use the skills and knowledge obtained to steer their career advancement. Apart from the masters degree, students can study four modules for a Postgraduate Certificate or eight modules for a Postgraduate Diploma.

Teaching will be delivered through the University's online virtual learning environment, Campus Moodle, allowing students to interact with tutors and fellow students around the world. Online study allows for a diverse range of teaching and learning methods to be employed including interactive online discussions (including tutor-student and student-student interaction), and all supported by a dedicated technical team. The use of diverse and hi-tech learning methods promises the student a stimulating, interactive and informative learning experience.

Online Learning

Our supported distance learning mode of delivery allows you to study online from any location and is designed to fit in around your work commitments. You will be taught and supported by experienced industry professionals who will recreate the same challenging interactive format of the on-campus courses for those studying at a distance.

Our virtual learning environment, CampusMoodle offers students flexibility of where and when they can study, offering full and open access to tutors and other class members. Students have the benefit of being part of a group of learners with the invaluable opportunity to participate in active, group-related learning within a supportive online community setting. The online campus provides students with lectures and course materials and it also includes:

As online learners, students are part of a 'virtual cohort' and the communication and interaction amongst members of the cohort is a significant aspect of the learning process.

Assessment methods

The course is largely assessed by way of coursework which can be completed remotely.

There is now a portfolio of assessments for the first stage – which tests students knowledge and skills in a range of different ways but which is largely undertaken in the University’s online teaching environment. This portfolio does include one closed book exam for each of the arbitration and adjudication routes (and two over two years for the "joint" route (Route C), however. This is to be sat at a venue which is arranged by the student – with the support of the University.

The second stage is assessed by way coursework submissions in answer to questions posed by teaching staff and the third stage requires submission of a 15,000 word dissertation.

With its practical perspective and recognition from the Chartered Institute of Arbitrators (CIArb), this course provides a professionally recognised qualification. The Bar Professional Training Course (BPTC) offers intensive, post graduate-level studies to students who wish to qualify as a barrister.

The BPTC is taken after undergraduate study and before the period of work based training, also known as pupillage, required for those training to become barristers.

This programme will prepare you for the 12 months of pupillage and ensure that you acquire the skills, knowledge of procedure and evidence, attitudes and competence required during your work based training. It will also provide you with a solid foundation in knowledge and skills for your early years of tenancy.

The BPTC aims to foster a professional and ethical approach to practice as a barrister, whilst giving you an informed view of a barrister’s working life.

Distinctive features

We have delivered a high quality and highly regarded Bar Professional Training Course/Bar Vocational Course since 1997. Distinctive features include:

• a guaranteed period of two weeks' placement (offering mini-pupillage with a local Chambers or other placement with the employed Bar, and marshalling with a local Circuit Judge and District Judge);

• a high level of individual feedback and support on performance in oral and written skills;

• a course strongly supported by the local employed Bar, the independent Bar and the Judiciary;

• the opportunity to practise all skills exceeds the Bar Standards Board’s minimum recommended number.

Structure

The BPTC is a one year course studied over three terms. All modules within this programme are compulsory and comprise knowledge areas, core skills and options. An attendance record is kept and 100% attendance at teaching sessions is expected.

Teaching

You will be taught through a mixture of lectures and small group sessions. Most teaching is delivered in small groups of 12 students with all oral skills teaching in smaller groups of six students.

You will have practice opportunities through your teaching that exceed the minimum indicated by the Bar Standards Board. The timing of teaching sessions and assessments has also been carefully considered to ensure that you have sufficient opportunity to practise and receive feedback. This is essential to enable you to refine your work and skills as a result of feedback received.

Assessment

The BPTC assessments are designed to be fair, rigorous, realistic and provide sufficient depth and/or breadth of coverage of the skills and subjects assessed. Individual assessments will cover a representation of the outcomes in the particular subject or skills area. A practical emphasis will appear throughout.

Each skills teaching session is a formative session; in addition you will undertake a practice assessment for each of the core subjects studied in terms one and two. These assessments will be undertaken in circumstances that reflect the arrangements for the summative assessments.

Three assessments, civil litigation evidence and remedies, criminal litigation evidence and remedies and professional ethics will be assessed by way of a centrally set paper produced by the Bar Standards Board.

For all Cardiff-produced BPTC assessments, the assessment criteria and, where relevant, guidance/explanatory notes will be made available to you from the outset of the subject. The assessment criteria for each subject are clearly aligned with its learning outcomes to ensure you can demonstrate you have achieved the learning outcomes for the subject through the assessment.

There are 12 summative assessments. Four are knowledge assessments, one in each of the following:

Civil litigation and evidence
Criminal litigation, evidence and sentencing
Professional ethics
Resolution of disputes out of court.

There are eight skills assessments, in each of the following:

Conference skills

Career prospects

Legal 40 Mentoring Network

The Glasgow Legal 40 is an initiative designed for University of Glasgow School of Law Diploma students. The group comprises 40 successful University of Glasgow legal alumni, drawn from all sectors of the legal profession. The main activities of the group include a mentoring programme and a series of social and educational events which allow Diploma students to engage with distinguished members of the legal profession and which will benefit the next generation of lawyers to emerge from the School of Law.

Since 2013, the group has been strengthened and developed by the introduction of Glasgow Legal 40 associates. This involves students who benefited from support and mentoring offered by Glasgow Legal 40 members undertaking the same role for their successors.

Launched in September 2010, our programme aims to bridge the gap between academia and professional legal practice; the Glasgow Legal 40 is a unique and key initiative which allows us to achieve our goal of ensuring our students are not just employable, but sought after by employers. Eileen Paterson, Director of Professional Legal Practice (Operations) explains: “The Glasgow Legal 40 initiative has already been of enormous benefit to our students.
