The applicability of Council Directive 93/13/EEC of 5 April 1993 on unfair terms in consumer contracts in mortgage enforcement proceedings in Ireland.

Project Objectives

To determine whether, under Directive 93/13 (“the directive”), the Irish courts have been assessing, of their own motion, whether a contractual term falling within the scope of the directive is unfair, thereby addressing the imbalance which exists between the mortgagor and mortgagee; and to determine whether an applicant in mortgage enforcement proceedings can rely upon Irish legislation, the common law rules of contract and rules of procedure, to secure possession of a mortgaged property in cases where the directive is applicable.

Methodology proposed

Qualitative research:

interviews with applicants and respondents in mortgage enforcement proceedings in relation to their knowledge of the applicability of the directive in respect of the proceedings in question and the extent to which their legal advisers and the courts/masters have been willing to entertain submissions based on the directive.

Quantitative research:

analysis of court reports and Law reports, and a statistical analysis of the numbers and types of cases before the courts/masters in mortgage enforcement proceedings where the directive has been cited (and in cases where it has not, why not) and the role the directive played in determining the outcome of the proceedings.

Expected outcomes: (e.g. deliverables & strategic impacts)

Outcome:

to produce a comprehensive body of knowledge on (i) the efficacy of the directive in mortgage enforcement proceedings, (ii) the extent to which its potential effect is understood by applicants and respondents, and, (iii) the type of mortgage agreements which may be successfully challenged by respondents in enforcement proceedings, in particular those where the court has assessed, as it must under the directive, whether the mortgagee, dealing fairly and equitably with the mortgagor, could reasonably assume that the mortgagor would have agreed to such a term in individual contract negotiations.

Impact:

this research may result in disseminating to consumers, legal advisers, financial institutions, and governmental authorities the role that the directive can play in ensuring that the interests of the weaker party, i.e., mortgagor, are protected in enforcement proceedings.

The course will provide an object-based learning experience through direct access to the reserved collections of the Victoria and Albert Museum (V&A) and the British Museum.

The lecture programme is supported by field trips to museums, galleries and private collections. The course is designed to train museum curators or serious collectors. It will also prepare students for work in a variety of professions in the art and the museum world and provides a pathway to the master’s degree for those with no background in the subject.

Museums and curators in Asia, and museums specialising in non-Western collections elsewhere, will find it an attractive, object-focused training opportunity for enhancing curatorial skills in the study, display and cataloguing of art objects in a fully-resourced academic environment.

Students can choose one or more in combination of the three-month modules on offer annually, which are listed below. Those who successfully complete a single module will be awarded a certificate. Lectures are given by museum curators, university lecturers and international experts and are (generally from 10:00 to 15:30) on three and a half days a week. The weekly review sessions with course tutors involve revision, slide tests and seminars. Students have regular access to the study of objects in the reserve collections at the British Museum, the Victoria and Albert Museum (V&A) and guided visits to other museums. Course content

You will investigate and evaluate the range of alternative approaches to Logistics and Supply Chain Management today, looking forward over the next five years, making use of theoretical and industry sources. Every stage of the supply chain, from raw material supply to resource recovery will be covered, as will the many modes of transport, on land, sea and in the air.

Strategic issues such as multi-channel retailing, supply chain collaboration and lead time compression will be covered in workshop style sessions led by our experienced teaching staff, many of whom have previously held board level appointments in globally renowned logistics companies.

Topics of global significance, such as disaster relief and sustainable distribution, are also included in a broad and topical study programme.

The taught programme for the MSc in Process Systems Engineering is delivered from October to February and is comprised of six compulsory taught modules. There are four optional modules to select the remaining two modules from.

Group project

The Group Project, which runs between February and April, enables you to put the skills and knowledge developed during the course modules into practice in an applied context while gaining transferable skills in project management, teamwork and independent research. The group project is usually sponsored by industrial partners who provide particular problems linked to their plant operations. Projects generally require the group to provide a solution to the operational problem. Potential future employers value this experience. This group project is shared across the MSc in Process Systems Engineering and other courses, giving the added benefit of gaining new insights, ways of thinking, experience and skills from students with other backgrounds

During the project you will develop a range of skills including learning how to establish team member roles and responsibilities, project management, and delivering technical presentations. At the end of the project, all groups submit a written report and deliver a presentation to the industrial partner. This presentation provides the opportunity to develop interpersonal and presentation skills within a professional environment.

It is clear that the modern engineer cannot be divorced from the commercial world. In order to provide practice in this matter, a poster presentation will be required from all students. This presentation provides the opportunity to develop presentation skills and effectively handle questions about complex issues in a professional manner.

Part-time students are encouraged to participate in a group project as it provides a wealth of learning opportunities. However, an option of an individual dissertation is available if agreed with the Course Director.

Individual project

The individual research project allows you to delve deeper into a specific area of interest. As our academic research is so closely related to industry, it is very common for our industrial partners to put forward real-world problems or areas of development as potential research topics.

The individual research project component takes place between April/May and August for full-time students. For part-time students, it is common that their research projects are undertaken in collaboration with their place of work under academic supervision; given the approval of the Course Director.

Individual research projects undertaken may involve designs, computer simulations, feasibility assessments, reviews, practical evaluations and experimental investigations.

As a research active university, international level research findings by Brunel Business School tutors are regularly used in lectures. Tutors on this programme are leaders in the field of management and active researchers within one of the six centres of research within the School.

Modes of Study

1-year full-time in September: The taught element of the course (September to April) includes eight modules; delivery will be by a combination of lectures, seminars and tutorials/group work. A further four months (May to September) is spent undertaking the dissertation.

Work Placements

MSc Management with 14 weeks Work Placement (Optional)
The MSc Management (with Professional Practice) incorporates a compulsory work placement component of 14 weeks which allows students to take their learning outside the classroom and pairs them with companies in the UK.

Brunel Business School is amongst the first few Business Schools in the UK to introduce postgraduate placements for students completing their Masters programmes as far back as 2011. This feature, pioneered in the UK for undergraduate students by Brunel University, is becoming more popular amongst more mature students, for whom such a placement can often serve as a springboard to often extremely competitive labour market. Postgraduate work placement employers cover all related expenses with many also providing a salary.

Teaching

As an active research university, international level research findings by Brunel Business School tutors are regularly used in lectures. Tutors on this programme are leaders in the field of management and active researchers within one of the six centres of research within the school.

Modes of Study

1-year full-time in September: The taught element of the course (September to April) includes eight modules; delivery will be by a combination of lectures, seminars and tutorials/group work. A further four months (May to September) is spent undertaking the dissertation.

1-year full-time in January: The taught element of the programme includes 8 modules which are delivered in two terms (four in January to April, and four in September to December); delivery will be by a combination of lectures, seminars and tutorials/group work. The dissertation is undertaken May to August, and then can be completed January to March after the second teaching term.

Assessment

Modules are typically assessed by individual assessment and an examination in May.

Teaching methods include lectures and informal small study groups.

Coursework and examination assignments place considerable stress on the ability to think and reason critically, but constructively.

The dissertation (12,000 words) is the capstone demonstration of these various skills, requiring students to conceive, justify, design in detail and execute a major project.

Assessment may include some numerical analysis tasks as well as reporting on published financial data.

Tasks related to the gathering of published data or field investigation to new data.

Individual and/or group presentations using laptops, PCs and digital projectors.

About the course

With employees now recognised as a key resource, the MSc in Human Resource Management offers students the opportunity to explore in depth the theoretical and analytical issues in the management of human resources and the roles these play in organisation success.

Students will examine a full range of HRM approaches, techniques and methodologies. The course is designed for those who wish to become humane resource practioners in academic, consultancy or commercial settings. It is also suitbale for students looking to undertake further research in academic consultancy or commercial settings.

The compulsory modules on the course are in relation to Human Resource Management contexts, concepts and practices, and contemporary issues such as talent and leadership recruitment and selection, reward management, performance management and facilitating learning and development in organisations.

Issues in international human resource management such as expatriation, managing across cultures will also be covered, as well as HR systems and processes from an international perspective. A number of leading edge optional modules are available on the programme including Global Diversity Management; Ethics and Corporate Governance.

Aims

You will be provided with a critical theoretical and applied knowledge and understanding of human resource management.

Graduates as prospective entrants to human resources management roles, as 'thinking performers', should be able to address business and professional situations knowledgeably, making contributions to improved organisational performance and delivery of sound personnel/human resources practice and services
